Heard Mr. R Ali, learned counsel appearing for the petitioners. Also hea rd Mr. K Munir, learned Additional Public Prosecutor, Assam. This is an application under Section 438 Cr.P.C., filed by the petitione rs, namely, 1. Sri Jamal Uddin @ Md. Jamal Ali, 2. Sri Reaz Uddin Ali and 3. Md. Barek Ali for granting the privilege of pre-arrest bail in connection with Chha ygaon P.S. Case No.26/2011 under Section 498(A) IPC. Mr. Munir, submits that he has received the case diary and on perusal of the same found no such incriminating materials available against the petitioner s so far collected by the Investigating Officer. I have also perused the case di ary. In view of the above and also considering the materials available in the case diary so far collected by the Investigating Officer, the interim bail gran ted to the petitioners abovenamed on 07.03.2011 is hereby made absolute, subject to the following conditions: 1) That the petitioners shall make themselves available before the Inves tigating Officer as and when required. 2) That the petitioners shall not directly or indirectly make any induce ment, threat or promise to any person acquainted with the facts of the case so a s to dissuade him/her from disclosing such facts to the Court or to any Police O fficer. This bail application stands disposed of.
