This is an application under Section 438 of the Code of Criminal Procedure, 1973 filed by the petitioners, namely, 1. Mr.Duha Seikh,s/o Moktel Seikh 2. Mr.Foiaj Uddin,s/o late Saban Ali,3. Mr Khayar Ali ,s/o Md Askar Ali,4. Mr Sahar Ali,s/o late Jonek Seikh,5. Mr Askar Ali,s/o late Kurpan Ali 6. Mr Sahar Ali,s/o late Son or Ali and 7. Mr Manik Ali, s/o late Duha Seikh seeking pre-arrest bail apprehen ding their arrest in connection with Kokrajhar P.S.Case No. 67/2013 u/s 147/1 48/ 149/ 447/ 323/ 326 IPC. Heard Mr.IA Talukdar, learned counsel for the petitioners and Mr.B.S.Sinha, lear ned Addl. P.P, Assam, who has produced the concerned case diary pertaining to Ko krajhar P. S. Case No. 67/2013 . Upon hearing the learned counsel for the parties, on perusal of the case diary a nd on going through the statements of the witnesses, the prayer for pre-arrest b ail is accepted. Accordingly, in the event of arrest of the petitioners above na med in connection with the said Kokrajhar P.S.Case No. 67/2013, they shall be r eleased on bail on furnishing a bail bond of Rs.20,000/-each with one local sure ty each of the like amount to the satisfaction of the arresting authority. The p etitioners shall appear before the concerned I.O. in connection with the aforesa id Kokrajhar P.S. case on or before 29.6.2013 for recording of their statements and they shall cooperate with the investigating officer of the case as and when called for. Return the case diary. The bail application stands disposed of.
