Judgment
Operative part
Heard Mr. Barbhuiya, the learned counsel for the petitioners as well as Mr. BS S inha, learned Public Prosecutor, Assam for the respondents. The petitioners, by the present petition, are seeking the privilege of pre arres t bail under Section 438 Cr.P.C. apprehending arrest in connection with Silchar PS Case No. 1541/2011 registered under Section 419/420/468/406/34 IPC. The said case has been registered on the basis of the FIR lodged on 29.8.2011 al leging commission of the offence punishable under Section 419/420/468/406/34 IPC . The allegations against the petitioners, who are the directors of the Company, are of very serious nature and in the event the petitioners are granted the pri vilege of pre arrest bail it will definitely hamper the investigation. That being the position, I am of the view that it is not a fit case to grant the privilege of pre arrest bail to the petitioners. Hence the prayer for pre arrest bail stand rejected. The pre arrest bail application stands dismissed.
