This is an application under section 438 of the CrPC in Patacharkuchi P S Case N o.92/2011 registered under sections 498(A)/34 of the IPC. Considering the materials in the case diary produced by Mr. B S Sinha, learned A ddl. P.P. and seeing that the main accused (husband of the victim lady) is alrea dy arrested, I am inclined to grant bail to the petitioner as she does not have common residence with her son. Accordingly this bail application stands allowed in terms of the interim order d ated 23.9.2011.
