It appears from the bail order dated 16.3.2012 passed by this C ourt in BA 517/2012 that one Shri Sanjoy Sarkar, constituted attorney of the own er of the land in dispute and Shri Raju Singha caretaker of the land who were im plicated in the present case, have been enlarged on regular bail. On perusal of the case dairy, it appears that the accused petit ioner, who is an associate of Sanjoy Sarkar, the constituted attorney and the ow ner of the said plot of land, is in physical possession of the plot of land in q uestion . That being the position, the interim bail order dated 3.4.12 is hereby made absolute on the same terms and conditions and also on conditions la id down u/s 438(2) CrPC. The accused petitioner shall again appear before the I. O. concerned to assist the Investigating Agency within 10 days from to-day. This Anticipatory Bail application stands disposed of.
