JUSTICE SANJAY KUMAR MEDHI Date : 23-03-2022 ORDER Heard Shri A Sharma, learned counsel for the applicant, namely, Sahanara Begum, who has filed this bail application under Section 439 of the Cr.PC praying for bail in connection with Nagaon Sadar PS Case No.3445/2019 (GR No.7120/2019) under Section 22 (C) of the NDPS Act. Page No.# 2/2 The applicant was arrested on 15.11.2021 and has, in the meantime, completed around 128 days in custody. Shri BB Gogoi, learned Addl. Public Prosecutor, Assam by producing the Case Diary has submitted that the quantity involved is a commercial one and therefore, releasing the applicant on bail, at this stage, may not serve the interest of justice. After hearing the learned counsel for the parties and on perusal of the materials in the Case Diary, including the seizure list, there is no manner of doubt that the seized quantity of the psychotropic substance would come under the commercial quantity. This Court has also seen that the substance involved is of chemical in nature in the form of tablets etc. Considering the facts and circumstances and the ill effects of drugs which has the propensity to destroy the entire generation, this Court is not inclined to grant bail to the applicant, at this stage which is accordingly rejected.
