Vide order on sentence dated 29.08.2023, the appellant was directed to undergo rigorous imprisonment for a period of 10 years for the offence punishable under Section 376(2) IPC, alongwith payment of fine of Rs.10,000/-, in default whereof he was directed to further undergo simple imprisonment for a period of three months. Learned counsel for the appellant contends that not only in the testimony but also in her statement recorded under Section 164 Cr.P.C. the prosecutrix has stated that she was willing to marry the appellant. He further submits that the appellant has undergone about 3 years out of the total sentence of 10 years imposed upon him. 4. Learned APP for the State, duly assisted by learned counsel for the victim, has opposed the present application. It is stated that the child victim was 15 years of age at the relevant time and her consent with respect to the commission of the offence is immaterial. The testimony of the child victim would show that she has stated that the appellant established physical relations with her despite her protest. Learned APP has also referred to the MLC as well as the FSL report to submit that the same supports the case of prosecution. 5. In view of the aforesaid and looking into the nominal roll, I find no ground to entertain the present application. Accordingly, the present application is dismissed at this stage.
