The petitioner is aggrieved by the order passed by the learned AdditionalRent Controllerwherebyhis evictionpetitionunder Section14(l)(e) of the Delhi Rent Control Act has been dismissed on the ground that the eviction petition ^did not contain the averments to the effect that he was the owner of the tenanted premises and also that he had let out the same to the respondent herein, which were the main ingredients of Section 14(l)(e). After making some submissions, learned counsel for the petitioner sought permission to withdraw this petitionso that he can file a fresh evictionpetitionwith all necessary averments. This petition is accordingly dismissed as withdrawn. As also prayed, the petitioner would be at liberty to file a fresh eviction petition.
