The present petition has been filed by the petitioners impugning an order dated 18.11.2025 issued by respondent no.3 (Ministry of Consumer Affairs). The said order rejects the petitioners’ application for registration of the society “GLIPA-IPA” under the Societies Registration Act, 1860. W.P.(C) 19475/2025 4. It is submitted that the impugned order proceeds on a factually incorrect premise, viz., that the petitioners seek registration under the name “Global Intellectual Property Alliance (GLIPA-IPA)”. Attention is drawn to an order dated 04.09.2025 passed by this Court in a previous writ petition, i.e., W.P.(C) 13613/2025, filed by the same petitioners, wherein the following order was passed: “3. The limited grievance canvassed by the petitioner is that there has been unexplained and unjustified delay by the respondent no.2/ Registrar of Firms and Societies, South-East Delhi, and the respondent no.3 /Ministry of Consumer Affairs, in granting registration to the petitioner under the Societies Registration Act, 1860. W.P.(C) 13613/2025 4. It is stated that the proposed name of the Society is ‘GLIPA-IPA’. It is submitted that despite all statutory compliances, the registration of the society has been stalled for unknown reasons, and no communication has been provided to the petitioner as regards the cause for the delay. 5. Learned counsel for the respondent no.2, who appears on advance notice, submits that while processing the petitioner’s application for registration, a reference was made by the said respondent to the Ministry of Corporate Affairs, on the ground that the petitioner’s proposed society claims to be the Indian chapter of the Global Intellectual Property Alliance (GLIPA). It is submitted that there was an apprehension on account of the use of the word “global” in the aforesaid description. 6. Learned senior counsel for the petitioner submits that the apprehension of the respondent no.2 is misplaced inasmuch as the name of the society does not include ‘global’. Attention is drawn to the proposed Memorandum of Association (which is appended as Annexure P-1 to the present petition) which clearly discloses the name of the society to be ‘GLIPA’. 7. In view of the limited relief sought by the petitioner, the petition is disposed of with the following directions:- i. The Ministry of Corporate Affairs shall respond to the reference made by the respondent no.2 vide letter dated 15.08.2025. Let the same be done within a period of three weeks from today. It shall be taken into account that the proposed name of the society does not This is a digitally signed order. Thereafter, the respondent no.2 shall take expeditious steps for registration of the society’s name after compliance of all necessary formalities. 8. It is submitted that even the aforesaid order categorically notes that the society’s name is “GLIPA-IPA” and that it does not include the word “Global” as part thereof. 7. Directions were issued to the concerned Ministry, i.e., Ministry of Consumer Affairs, to decide the matter taking note of the aforesaid circumstances. However, the Ministry of Consumer Affairs has now issued an order dated 18.11.2025, once again rejecting the petitioners’ name on the ostensible basis that there are multiple references to “Global Intellectual Property Alliance” in the Memorandum of Association of the petitioner. 8. Attention is drawn to the amended Memorandum of Association of the petitioners, which contains no references whatsoever to “Global Intellectual Property Alliance”. 9. Issue notice. 10. Learned counsel, as aforesaid, accept notice on behalf of the respondent/s. 11. Learned counsel for the Ministry of Consumer Affairs accedes that since the amended Memorandum of Association of the petitioners does not include the expression “Global” in the context of the petitioners’ Society and does not even refer to “Global Intellectual Property Alliance,” there is no objection on the part of the concerned Ministry to the registration of the said society.
