These petitions under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 20231 (corresponding to Section 482 of Criminal Procedure Code, 19732) seek quashing of two FIRs, FIR No. 208/2022 dated 27th February, 2022 [subject matter of CRL.M.C. 8451/2025] and FIR No. 218/2022 dated 7th March, 2022 [subject matter of CRL.M.C. 8456/2025 and CRL.M.C. 1 “BNSS” 2 “CrPC” This is a digitally signed order. Neb Sarai, Delhi, under Sections 323, 341, 506 and 34 of the Indian Penal Code, 18603. The petitions are founded on a settlement arrived at between the Petitioners and the respective complainants in the two FIRs. 2. FIR No. 208/2022 was registered on the complaint of Shivani Wadhwa, resident of Sainik Farms, New Delhi, who alleged that on 27th February, 2022, at about 1:30 PM, while she was cooking, her mother-in-law Neena Wadhwa began abusing her and stopped her from cooking. When she and her daughter Seerat objected, Neena Wadhwa allegedly became violent, assaulted Seerat, and then hit the complainant with a stick and kitchen utensils. She further alleged that her husband Ashish Wadhwa pushed both of them and continued abusing the complainant. The complainant stated that her mother-in-law deliberately twisted her own finger to fabricate an injury and falsely implicate her daughter. She further alleged that when her sister and brother-in-law arrived, both accused persons abused them, and Ashish struck her brother-in-law. She claimed to have video recordings of the assaults and stated that she, her daughter, and her brother-in-law sustained injuries. 3. Conversely, FIR No. 218/2022 was registered on the complaint of Ashish Wadhwa. He alleged that since 2020, numerous matrimonial disputes have been ongoing with his wife (Shivani Wadhwa), who resides with him along with their two daughters, Seerat and Sehar and his elderly mother. He alleged that on 27th February, 2022, a quarrel occurred in the house when his daughter Seerat allegedly pushed his mother Neena Wadhwa out of the kitchen by pressing her hand, causing her pain, and his wife Shivani began 3 “IPC” This is a digitally signed order. He further alleged that when he attempted to take his mother to the hospital, his wife and Seerat obstructed the vehicle. Shortly thereafter, Shivani’s sister, Shruti Kapoor, and her husband, Manik Kapoor, arrived, whereupon Manik allegedly assaulted him and Shruti allegedly pressed his mother’s injured hand. He asserted that his wife, daughters, and in-laws had assaulted and quarrelled with him and his mother. 4. The parties state that they have amicably resolved their disputes and differences. A Settlement Deed has been executed between Ashish Wadhwa, Shivani Wadhwa, Seerat Wadhwa, Sehar Wadhwa and Neena Wadha on 27th February, 2025, a copy of which has been duly placed on record. Under the settlement, the complainants have mutually undertaken to withdraw all allegations levelled against each other and to jointly seek quashing of the proceedings arising from the two FIRs. 5. The complainants are present before the Court in person and have been duly identified by the Investigating Officer. They have expressed their unequivocal consent to the settlement and their intent not to pursue the two FIRs any further. The complainants have filed an Affidavit/No-Objection Certificate affirming that the compromise was entered into voluntarily, without any coercion, pressure, or undue influence. By the Affidavit/No Objection Certificate filed in CRL.MC. 8632/2025, the complainants in FIR No. 218/2022 have also given their consent to quash the FIR against co-accused Shruti Kapoor and Manik Kapoor. 6. The Court has considered the submissions advanced by the parties. It is pertinent to note that the offences under Sections 323, 341 and 506 IPC are compoundable in nature. However, that does not debar the High Court from resorting to its inherent power under Section 528 of BNSS This is a digitally signed order. Having regard to the nature of the dispute and the fact that the aggrieved parties have amicably settled the matter, this Court is of the view that continuation of the criminal proceedings would serve no useful purpose. In the circumstances, this is a fit case for exercise of jurisdiction under Section 528 of BNSS, as the continuance of proceedings would amount to an abuse of the process of law and impede the ends of justice. 8. Accordingly, the present petitions are allowed and FIR No. 208/2022 and 218/2022, along with all consequential proceedings emanating therefrom, are hereby quashed. 9.
