Application under Section 483 B.N.S.S. has been filed on behalf of the Petitioner / Applicant for grant of Interim Bail for 03 months on medical grounds in FIR No.0670/2022 under Sections 326A/120B IPC and Section 4(2) Poisons Act, 1919, registered at PS: Mohan Garden, Delhi. 2. Learned counsel for the Applicant submits that the Applicant is suffering from various ailments as detailed below: i) Right Appendicular Mass (Appendix); ii) Seizure Disorder; iii) Piles (Anal Fissures); iv) Low back ache with right lower limb Radiculopathy; v) Deviated Nasal Septum; and vi) Bronchial Asthma. 3. Jail Visiting Surgery SR from DDU Hospital had advised the Applicant to undergo operation for treatment of Piles and Deviated Nasal This is a digitally signed order. The Applicant was taken to Safdarjung Hospital for treatment of Low back ache with right lower limb Radiculopathy and he was advised to undergo a MRI Spine, which is scheduled for 22.03.2026. He was advised to undergo Septoplasty Surgery by the DDU Hospital during his follow up visit on 02.08.2025. He suffers from Bronchial Asthma and has been advised MDI Inhaler and Oxygen Therapy on few occasions keeping while he is admitted in MI Room. The Applicant submits that he is suffering from various medical issued, which is confirmed by SMO, Central Jail-01, Tihar. 4. The Applicant had filed an Application for grant of Interim Bail for six months before the learned Trial Court, which was dismissed vide Order dated 15.09.2025 by directing the Jail Authorities to get the Applicant treated in AIIMS and submit the Medical Report received from AIIMS. The findings of AIIMS were summarized in the 8Medical Status Report9 submitted by SMO, Central Jail-01, Tihar, before the learned Trial Court, wherein it was indicated that the Department of General Surgery, AIIMS for his complaints of P/R Bleeding and appendicular mass, on examination anal fissures were observed at 3, 6 and 9 O9Clock position (in last Report, there were two anal fissures only) and have advised to review with USG W/A. 5. On 18.09.2025, he was thoroughly examined by Department of ENT and diagnosed to have right sided DNS (Deviated Nasal Septum) following history of nasal trauma in childhood which is causing right nasal obstruction with occasional bleeding. On 20.09.2025, Neurology Department, AIIMS Hospital also examined him being a known case of seizure disorder, wherein he was thoroughly examined, prescribed readjusted anti-seizure medication i/v/o on and off positive history of seizure episode despite compliance to This is a digitally signed order. On 20.09.2025, he was examined at Department of Medicine as a follow up case of bronchial asthma/allergic rhinitis, based on chest auscultatory findings started appropriate MDI inhalers and further referred to Haematology Department i/v/o severe Anaemia and Pancytopenia. 7. On 22.09.2025, Ortho review i/v/o low back ache with lower limb radiculopathy of the Applicant was done at AIIMS Hospital, wherein he has been prescribed appropriate treatment and called for review after MRI LS Spine. 8. The Application for grant of Interim Bail was dismissed by the learned Trial Court, vide impugned Order dated 03.11.2025, by observing that he is being given treatment at AIIMS Hospital. 9. Present Bail Application has been filed for grant of Interim Bail on the ground that the Applicant is suffering from various ailments and there is no improvement in his condition. Therefore, he intends to get himself treated in a private Hospital, for which he may be granted Interim Bail for three months. 10. Medical Status Report of the Applicant has been received from Jail Authorities, which has reaffirmed about the ailments and treatment being given at AIIMS Hospital. Submissions heard and record perused. 11. Considering the detailed Medical Report of the Applicant, who is suffering from various ailments, especially considering that he needs to get MRI done of the complaint of Seizure Disorder and also needs treatment for Piles (Anal Fissures), the Applicant is granted three weeks9 Interim Bail on the following terms and conditions: This is a digitally signed order. The Order is downloaded from the DHC Server on 18/12/2025 at 11:55:52 a) The Petitioner/Accused shall furnish a personal bond of Rs.50,000/- and one surety of the like amount, subject to the satisfaction of the learned Trial Court; b) The Petitioner/Accused shall appear before the Court as and when the matter is taken up for hearing; c) The Petitioner/Accused shall provide his mobile number/ changed mobile number to the IO concerned which shall be kept in working condition at all times; d) The Petitioner/Accused shall not indulge in any criminal activity and shall not communicate or intimidate the witnesses or tamper with the evidence; and e) In case the Petitioner/Accused changes his residential address, the same shall be intimated to learned Trial Court and to the concerned I.O. 12.
