This petition has been filed seeking directions to respondents to comply with the admission process, which fructified in favour of the petitioner/child, belonging to the Economically Weaker Section (‘EWS’) category, for the academic session 2025-26. After a computerized draw of lots conducted by respondent no.1/Directorate of Education (‘DOE’), result was declared, confirmed and published online. Thereafter, an order was issued for admission under EWS category after verification of documents on 22nd March 2025. 2. Petitioner received confirmation of selection and allotment of petitioner/child to respondent no.4/Kulachi Hansraj Model School, Ashok This is a digitally signed order. Despite the petitioner’s parents approaching the school, the admission has not been secured in favour of the petitioner/child. 3. It is pointed out by counsel for petitioner that previous orders have been passed in this regard in W.P.(C)2623/2025 and batch of connected matters comprising inter alia W.P.(C) 8679/2025 on 08th October 2025 by the Court. Relevant parts are extracted as under: “1. Mr. Rajshekhar Rao, learned Senior Counsel appearing on behalf petitioner, at the outset, invites attention of the Court to the order dated 03.03.2025 to contend that specific direction was given by this Court to decide the representation dated 26.12.2024 of petitioner within a period of two weeks. He submits that the very next day i.e. on 04.03.2025, the representation of petitioner was decided without assigning any reason. 2. Having perused the order dated 04.03.3025, this Court finds that no reason, whatsoever, has been assigned by respondent/DoE while deciding petitioner’s representation dated 26.12.2024 in which petitioner had given the data showing decline in number of admissions under the general category, and had accordingly, made a request for reduction in the EWS quota. 3. Mr. Rao submits that for the time being the concern of the petitioner is that the respondent/DoE should take an informed decision, and pass a speaking order. 4. In view of the above, order dated 04.03.3025 is set aside, and respondent/DoE is directed to pass a speaking order on the petitioner’s representation dated 26.12.2024 within a period of four weeks. In the facts and circumstances of the present case, it is also deemed appropriate that respondent/DoE shall afford a personal hearing to petitioner/school. Ordered accordingly. 5. Further, regard being had to the fact that number of candidates who were allotted petitioner school in the draw lots under the category of EWS/DG/CWSN are still sitting at home This is a digitally signed order. The Order is downloaded from the DHC Server on 01/11/2025 at 11:55:32 despite having been allotted petitioner no.1 school, petitioner school is directed to grant admission to such candidates forthwith. To be noted that some of those candidates have filed separate writ petitions, which are also listed today. 6. At this stage, Mr. Rao, on instructions, submits that on account of non-compliance of directions of DoE to admit students under the EWS/DG/CWSN category, DoE has issued show-cause notice under Section 24 of the Delhi School Education Act, 1973. 7. Considering that the respondent/DoE has been directed to decide petitioner’s representation dated 26.12.2024 afresh, it is further directed that till the time the respondent/DoE passes a speaking order on the said representation, no coercive action be taken against the school. 8. The petition along with pending application, is disposed of in the above terms.” 4. In view of the said order, the Writ Petition i.e. W.P.(C) 8679/2025 was allowed and disposed of. Respondent no.4/ Kulachi Hansraj Model School was directed to provide admission to petitioner therein. 5. Counsel for respondent no.4/ Kulachi Hansraj Model School states that W.P.(C)2623/2025 was filed by them challenging the allocation to the school of students belonging to EWS category. However, they wish to file an LPA in this matter. 6. Considering the circumstances, where the children are being denied admission, despite proper process having been followed, the Court is not willing to defer the matter to a later date, considering that the LPA has not been filed as of today and there is no order adverse to what has been extracted above. 7. Parents along with the petitioner/child will approach respondent no.4/ Kulachi Hansraj Model School tomorrow at 11:00 A.M. with relevant documents and the process of admission shall be carried out.
