The instant petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter “BNSS”) [earlier Section 482 of the Code of Criminal Procedure, 1973 (hereinafter “CrPC”)] has been filed by the petitioners praying for quashing of FIR no. 545/2025 registered at Police Station Seemapuri for offences punishable under Section 110/3(5) of the Bharatiya Nyaya Sanhita, 2023 (hereinafter “BNS”). 2. The brief facts of the case are that the petitioners and the respondents no. 2 & 3 were playing cricket in a playground in the District Park, Tahirpur when a heated discussion among the petitioners and the respondents took place. Later, while on their way home, respondent no. 2 and 3 were stopped This is a digitally signed order. Owing to the fact that the parties are adolescents/ young adults and they are capable of reform and learning how to conduct themselves in case of disagreement with other members of society, it is submitted that the petitioners and respondents no. 2 & 3 have settled their disputes amicably and are now moving forward towards a peaceful and harmonious future. 4. Settlement deed dated 11.09.2025 is on record and has been annexed as “Annexure B” to the petition. Qua this deed, the respondents no. 2 & 3 have agreed to withdraw the case arising out of FIR no. 545/2025 registered at Police Station Seemapuri against the petitioners. 5. It is prayed by the learned counsel appearing on behalf of the parties that the instant FIR may be quashed on the basis of the compromise. 6. Learned APP for the State, who appears on advance notice, accepts notice and submits that there is no opposition to the prayer made by the petitioners seeking quashing of the FIR in question in view of the settlement arrived at between the parties. 7. Heard learned counsel for the parties and perused the record. 8. The petitioner is present before this Court and have been identified by their counsel and Investigating Officer, Police Station Seemapuri. Respondents no. 2 & 3 are also present in the Court and has been identified by her counsel and the Investigating Officer. 9. On a query made by this Court, respondents no. 2 & 3 have categorically stated that they have entered into compromise on their own free will and without any pressure. It is also stated by them that the entire dispute has been amicably settled between the parties. This is a digitally signed order. Keeping in view the fact that the matter stands amicably been settled between the petitioners and respondents no. 2 & 3 amicably without any pressure, no fruitful purpose would be served by keeping the matter pending. 11. It is, thus, in the interest of justice to quash the afore-mentioned FIR and the proceedings emanating therefrom. However, it is imperative that the parties to the dispute reflect upon their actions and take the time to reform their behaviour, considering that they are young adults who will later contribute to shaping the future of this country. Therefore, this Court deems it appropriate to direct the parties to undertake community service as detailed hereunder. 12. Hence, in light of the judgment of the Hon’ble Supreme Court passed in Gian Singh vs. State of Punjab (2012) 10 SCC 303, FIR no. 545/2025 registered at Police Station Seemapuri for the offences punishable under Section 110/3(5) of the Bharatiya Nyaya Sanhita, 2023, and consequent proceedings emanating therefrom, are quashed qua the present petitioners, subject to the petitioners as well as respondents no. 2 & 3 performing community service starting from 01.11.2025, in the following manner: i. Petitioners and the respondents no. 2 & 3 are to perform community service for a period of one month, on every Saturday and Sunday, at Karuna Hospital, D-62, Pocket E, Dilshad Colony New Seemapuri, Dilshad Colony, New Delhi, Delhi, 110095, under the supervision of the hospital’s Medical Superintendent. ii. Upon completion of the said period, a certificate confirming the completion of community service shall be issued by the Medical Superintendent of the concerned Hospital to each of This is a digitally signed order. In the event of any absenteeism, default, or misconduct on the part of the petitioners and the respondents no. 2 & 3 during the course of the community service, the same will immediately be reported by the Medical Superintendent to the concerned SHO, who shall, in turn, inform the concerned APP to place the matter before this Court to seek appropriate orders. 13. With the above directions, the petition along with pending application(s), if any, stands disposed of. 14.
