First Bail Application has been filed on behalf of the Petitioner/Applicant Panna Ram @ Pawan @ Vinod under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 seeking Interim Bail for a period of four weeks in case FIR No.156/2021 under Section 302/201/394/411 IPC registered at Police Station Narela Industrial Area, for the purpose of completing his pensionary documents formalities so that he can get his pension. 2. It is submitted that the Applicant took VRS from FCI on 20.12.2018 and has become eligible for pension benefits under FCI Contributory Scheme in January, 2024. He had filed an Interim Bail Application bearing I.A. No.4 of 2024 in SC No.492/2021 which was dismissed vide Order dated 30.12.2024 on the ground that the Applicant had not filed any Application before FCI after obtaining the VRS until his arrest. It is submitted that the Applicant had not applied for his pensionary benefits before his arrest as he was not eligible at the said time. This is a digitally signed order. Subsequently, the Applicant filed Interim Bail to complete the procedural paper work for receiving the pensionary benefits vide Bail Application No.827/2025 which was disposed of vide Order dated 02.04.2025 with directions to submit the pensionary benefits Application through Jail Superintendent and further liberty was granted to move an Interim Application. 4. It is submitted that FCI had sent a letter dated 19.05.2025 along with the check list directing the Applicant to furnish the documents for processing his pensionary benefits. It is claimed that the Applicant is required to be physically present for the process of applying for pensionary benefits for the reasons that certain documents required by FCI has to be procured and updated for which personal presence is required. The Aadhar Card of the Applicant only has the Birth year. He has to carry the proof of Birth and physically visit the Aadhar Sewa Kendra for updation of his Aadhar Card along with the biometric. 5. It is further submitted that he has to submit his Passbook and canceled Cheque from his active Bank Account. For the past four years, his bank account has become inactive and he has to furnish fresh KYC to the Bank. The Applicant also has to submit the PAN that is linked with his Aadhar at the time of KYC for activating his Bank Account. There are other formalities for which his presence is required. 6. It is submitted that the Applicant has already lost one year and six months in getting his pensionary benefits. It is submitted that he has undergone four years of incarceration for an offence punishable for life imprisonment under UAPA. He is a Senior Citizen and is infirm. Therefore, a prayer is made that he may be granted Interim Bail for a period This is a digitally signed order. The Status Report has been filed on behalf of the State, wherein it is submitted that a Letter has been received from State Bank of India dated 18.10.2025, wherein it is clearly stated that the Account of the Petitioner is active and the last interest credit was made on 29.09.2025. It is further stated that the physical presence of the customer, is not required as he can withdraw cash through Cheque or ATM. 8. The learned APP for the State has also submitted the Report from the Manager (Labour Admin.) Division Officer, Shakti Nagar (FCI), New Delhi, who has submitted that no Application or document has been furnished to the FCI by the Applicant for grant of Pension. The Date of Birth is stated to be 01.01.1964, as per their office record. The documents which are required have been annexed along with their response. The Pension Form may be filled and duly signed by the Employee and documents completed in all respect and can be submitted by any family members or through post. Submissions heard. 9. Pertinently, similar Bail Applications had been filed by the Petitioner, which had been disposed of vide Order dated 02.04.2025 and 03.09.2024. 10. Considering that despite the two earlier Orders, the Petitioner till date has not made any endeavour to even make an Application for Pension and is persistently insisting that he is not in a possession of any documents, is only an evdeavour to seek the Bail. As per the submission made on behalf of the Petitioner, his son who is 23 years old comes to meet him regularly. There is no ground for grant of Interim Bail at this stage and the Application is accordingly dismissed. This is a digitally signed order. 11. It needs no reiteration that the Jail Superintendent shall provide full support to enable the Petitioner to submit his Pension Application before FCI. 12.
