JUSTICE SANJEEV NARULA O R D E R % 13.11.2025 1. There is no appearance on behalf of the Petitioner. Nonetheless, the Court has perused the record with the assistance of Ms. Rupali Bandhopadhyay, ASC for the State. 2. The Petitioner has filed the present petition under Article 226 of the Constitution of India, 1950 read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023,1 seeking protection of his life and liberty. The Petitioner also seeks directions restraining Respondent Nos. 3 and 4, police officials at P.S. Ghazipur, from harassing him. 3. The Petitioner’s primary grievance is directed against Respondent Nos. 3 and 4, who are alleged to be shielding certain anti-social elements operating in the vicinity of the Petitioner’s residence. It is specifically alleged that one Gaurav, who had been residing as a tenant in the 1 “BNSS” This is a digitally signed order. On the complaint lodged by the Petitioner’s daughter in this regard, FIR No. 132/2024 was registered at P.S. Ghazipur on 8th April, 2024 for the offences under Section 376 of the Indian Penal Code, 18602 and Section 4 of the Protection of Children from Sexual Offences Act, 2012. It is alleged that despite the registration of the said FIR, Respondent Nos. 3 and 4 have continued to harass the Petitioner and his family instead of conducting a fair and impartial investigation. 4. It is further submitted that following Gaurav’s death by suicide, another FIR, being FIR No. 170/2024, was registered at P.S. Ghazipur on 13th May, 2024, on the complaint of his mother under Sections 306/34 IPC. The Petitioner was arrayed as an accused in the said case and is on bail. It is alleged that no material has been found during the investigation linking the Petitioner to the alleged offence, and his implication is without any reasonable basis. 5. Subsequently, on 12th June, 2025, another FIR was registered against the Petitioner’s wife, at P.S. Ghazipur under Section 223(a) of the Bharatiya Nyaya Sanhita, 20233 on the allegation of failure to conduct tenant verification. The Petitioner contends that his wife has been wrongfully implicated in the said case, as the tenant named therein neither resides in their property nor has any connection with the premises owned by them. 6. It is alleged that the Petitioner, along with his family, is being unnecessarily harassed by the police officials. The Petitioner made several 2 “IPC” 3 “BNS” This is a digitally signed order. The Order is downloaded from the DHC Server on 17/11/2025 at 13:17:32 W.P.(CRL) 2418/2025 Page 3 of 7 complaints to the SHO, senior police officers, and even to the Lieutenant Governor of Delhi and the DCP, but no action has been taken thereon. In these circumstances, the present petition has been filed seeking directions to restrain Respondent Nos. 3 and 4 from harassing the Petitioner. 7. In response, the State has filed a detailed status report, delineating the following facts: “1.It is humbly submitted that the Petitioner has filed the present petition seeking protection of life and personal liberty against Respondents No. 3 and 4. The present status report is being filed in compliance with the order dated 05.08.2025 passed by this Hon’ble Court. 2. That the alleged incident took place during the intervening night of 07.04.2024 and 08.04.2024. On 08.04.2024 at 02:02 a.m., a PCR call was received vide GD No. 06A regarding "Rape of caller’s 15-year-old girl by the tenant". 3. Upon receiving the PCR call. W/SI Shalu along with other staff, including ACP/Night GOs, reached the spot where the victim and her family members were present. One boy was also found hanging from a ceiling fan with a ghamcha in a suspicious condition, in a room latched from the inside. The Crime Team, FSL Team, and Fire Brigade were called to the spot i.e. B-19, Gali No. 3, Ghazipur Dairy Farm. Delhi. The door was opened using an iron rod inserted from the adjoining window, and the boy was taken down by cutting the ghamcha. During the inspection of the body, several injury marks were found. Later, during inquiry, the Petitioner and his family identified the boy as Gaurav So Hiren. 4. Gaurav’s body was sent to LBS Hospital, where the doctor declared him Brought Dead on MLC No. 2604/24. The body was shifted to the mortuary, and his family was informed about the death. 5. The victim girl "M", daughter of the Petitioner, aged 15 years, was medically examined under MLC No. 43/24 and gave her statement against the deceased boy Gaurav. On this basis, FIR No. 132/2024 U/s 376 IPC and Section 4 of the POCSO Act was registered at P.S. Ghazipur. Delhi. 6. During the inquiry, statements of the Petitioner, his family, and other tenants were recorded, where the Petitioner and his family admitted that they had beaten the deceased boy before the hanging took place. Subsequently, the victim girl "M" in her statement U/s 164 CrPC, further revealed that Gaurav was also beaten by her brother before the hanging. 8. Since the deceased boy Gaurav was found hanging in suspicious circumstances and had injury marks on his body, inquiry was entrusted to Sl Ashish Panwar for further necessary action under the directions of senior officers. Further, the proceedings U/s 194 BNSS were conducted. 9.On 10.04.2024, the post-mortem of the deceased Gaurav was conducted at LBS Hospital Mortuary vide PM No. 184/2024 in the presence of his family members. After the post-mortem, the body was handed over to his mother, Tinku Roy, for last rites. On the same day. Tinku Roy submitted written complaint against the Petitioner, Manoj Bhati and his family laleging that they had murdered her son Gaurav. 10. The Post-Mortem Report No. 184/2024 was collected from LBS Hospital, where the doctor found multiple injuries, all ante-mortem and fresh in duration. The cause of death was opined as "asphyxia due to ante-mortem hanging, possible by the ligature material found in situ." 11. Based on these facts, a legal opinion was sought from the Legal Advisor (appointed by Delhi Police). After the discussion with senior officers, FIR No. 170/2024 U/s 306/34 IPC was registered at P.S. Ghazipur on the complaint of the deceased’s mother, Tinku Roy. The investigation was initially marked to Insp. Bharamdutta and later transferred to the Crime Branch (East), where it is currently under investigation. 12. On 28.12.2024, a complaint vide Ref. No. LPG-28 was received at P.S. Ghazipur from the Petitioner. Manoj Bhati, against one Hakim Kabadi regarding alleged theft of iron rods and encroachment on MCD Park. On 07.01.2025, during inquiry. SI Ashish Panwar proceeded to the alleged shop of Hakim Kabadi vide GD No. 15A and attempted to contact the complainant on his mobile number to identify the alleged stolen rods. However, he did not answer the call. Beat Officer HC Opin was then instructed to visit the complainant’s residence and inform him to reach the site for identification, but the Petitioner refused, stating. "Meri dushmani bandh jayegi, main nahi aata." 13. During further inquiry, the allegations made by the Petitioner were found unsubstantiated. A secret informer also reported that Manoj Bhati is a habitual complainant who frequently files false complaints against people to extort them. 14. During the inquiry on encroachment of the MCD Park by Hakim This is a digitally signed order. A complaint was lodged with MCD through the MCD Control Room vide Complaint No. 834 dated 07.01.2024. The beat officer was instructed to keep vigilance on any encroachment and inform concerned agencies if anything was found. Detailed entry was made at P.S. Ghazipur vide GD No. 93A dated 07.01.2025. 15. On 11.06.2025, during emergency duty, a PCR call vide GD No. 47A was received at P.S. Ghazipur regarding hanging in manoj bhati ka makan at B-19. Gali No. 3, Ghazipur Dairy Farm, Delhi. Upon arrival, Sl Ashish Panwar and staff where after checking from the "jali" of the door, it was found that one girl is hanging in the room from the window. which was in wall of the room with the help of ligature material and the room is locked from the inside. The Crime Team, East District, and Fire Brigade were called on the spot. The door was broken open and the girl was taken down. She was identified as Saba D/o Nafees, aged 14 years. She was taken to LBS Hospital, where the doctor declared her ’Brought Dead on MLC No. 3796/2025. The post-mortem was conducted vide PM No. 301/25, and the body was handed over to her father and proceedings U/s 194 BNSS were conducted. 16. On 12.06.2025, during door-to-door tenant verification, HC Opin found that some tenants were residing at B-19, Gali No. 3. Ghazipur Dairy Farm, Delhi, without proper verification. Upon inquiry, a tenant stated that he had been living there for 6-7 months without verification and named Urmila Bhati Wio Manoj Bhati, as his landlord. Upon inquiry. Urmila Bhati could not produce any tenant verification documents and failed to provide a satisfactory explanation to the same. Consequently, FIR No. 286/25 U/s 223(a) BNS was registered against her for violation of Notification No. 1545/1595/R-ACP/Madhu Vihar dated 21.04.2025, by HC Opin. 17. On 26.06.2025, a PCR call vide GD No. 54A was received regarding "caller Lady bol rhi hain ki meri 2 ladki shop se aa rhi thi to bich raste mei muslim ladko ne betamizi ki hain or meri ladki ko road per fek kr mara hain" at P.S. Ghazipur. The caller was identified as Urmila Bhati W/o the Petitioner. On responding to the call, SI Pradeep Kumar met the Petitioner, who stated that they had resolved the matter themselves and refused medical examination or any legal action. Hence, the PCR call was closed. 18. It is humbly submitted that the Petitioner has filed thousands of complaints against various police officials and local residents over the past few years based on concocted stories. Whenever asked to provide evidence in support of his allegations, he fails to do so. Now, he is filing This is a digitally signed order. His intention appears to be to intimidate the police so that no legal action is taken against him in the future. The Petitioner is misusing the grievance mechanisms provided by government departments for the redressal of genuine issues by repeatedly filing false and fabricated complaints and petitions. 8. A perusal of the status report reveals that the allegations made by the Petitioner regarding threat to life and liberty have been duly inquired into. The report outlines the incidents forming the backdrop of the present petition, when one Gaurav was found hanging in the Petitioner’s premises after the Petitioner’s minor daughter had accused him of sexual assault. Subsequent inquiry revealed that the Petitioner and his family had admitted to having beaten the deceased prior to his hanging, following which an FIR was registered on the complaint of the deceased’s mother. The report further discloses that several other incidents involving the Petitioner and his family. 9. It thus emerges that the allegations of threat and harassment made by the Petitioner are not supported by any credible material. The status report reflects a consistent pattern of the Petitioner filing numerous complaints against police officials and local residents, many of which, upon inquiry, were found to be false or unsubstantiated. Ms. Rupali Bandhopadhyay has further explained that the Petitioner has, over the years, filed thousands of such complaints based on concocted stories, and has repeatedly failed to produce any supporting material when called upon to do so. It is submitted that the present petition has also been filed with the intent to exert undue pressure on the authorities, particularly in view of the fact that two FIRs are presently pending against him. 10. In the opinion of the Court, the overall conduct of the Petitioner, as This is a digitally signed order. The Order is downloaded from the DHC Server on 17/11/2025 at 13:17:32 W.P.(CRL) 2418/2025 Page 7 of 7 borne out from the material on record, reflects a clear misuse of the State machinery through the repeated filing of frivolous and vexatious complaints, seemingly with the intent to intimidate law enforcement agencies and obstruct the due process of law. 11. While the relief sought by the Petitioner is innocuously framed as a request for restraining orders against Respondents No. 3 and 4 from allegedly harassing him, it is evident from the record that there is no basis for apprehension of any unlawful action against the Petitioner to warrant any directions from this Court. 12.
