The present application filed under Section 483 read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 20231 (corresponding to Section 439 read with Section 482 of the Code of Criminal Procedure, 19732) seeks grant of interim bail in connection with FIR No. 426/2017 dated 20th November, 2017, registered under Sections 394/397/302/34 of the Indian Penal Code, 1860 and Section 27 of the Arms Act, 1959 at P.S. Paschim Vihar, Delhi for a period of four weeks on medical grounds. 2. The Applicant seeks interim bail on humanitarian grounds, citing his deteriorating medical condition. In compliance with the said order, status report has been received along with medical report from the office of the Senior Medical Officer, Dispensary, Central Jail No. 10, Rohini, New Delhi. 3. The medical status report records that the Applicant has been suffering from Bronchial Asthma for the past four to five years, which developed following a bout of pulmonary tuberculosis, for which he had completed anti-tubercular treatment. Despite ongoing medication, he continues to experience symptoms such as breathlessness, cough, and chest pain. Owing to the aggravation of these symptoms, he was admitted for medical intervention on 18th August, 2025, for close monitoring and nebulization. Additionally, the report notes that the Applicant has sustained a right knee injury, with an MRI confirming a complex medial meniscus ligament tear and associated instability and locking of the knee. He remains under treatment at the Sports Injury Centre, VMMC & Safdarjung Hospital. The Chief Medical Officer has observed that, despite receiving regular treatment for his chronic ailments, including lower back pain with radiculopathy, knee injury, and asthma, the Applicant continues to suffer from these conditions, which significantly impact his ability to carry out day-to-day activities. Considering the above, the Applicant seeks to get treatment outside the custody and accordingly, seeks interim bail. 4. The status report, with the criminal antecedents of the Applicant have been noted. At the same time, the report itself notes, out of the three cases listed (apart from the subject FIR), the Applicant has already been acquitted in two. Mr. Sumeet Singh Shokeen, counsel for the Applicant, has placed on record a copy of the order dated 21st August, 2018, passed by the ASJ-02 (FTC) NDD/PHC/New Delhi in FIR No. 710/2017 whereby the Applicant was discharged in the said case. A copy of the said order is handed over and taken on record. 6. As per the latest nominal roll, the Applicant has been custody for 07 years, 07 months, and 13 days as of 21st August, 2025. His conduct for the past one year has been satisfactory. 7. In light of the above, and upon verification of the medical records by the State, along with the report submitted by the Medical Officer, the period of custody undergone, and considering the overall facts and circumstances of the case, the Applicant is hereby granted interim bail for a period of three weeks from the date of release, on humanitarian grounds. The bail is subject to the furnishing of a personal bond in the sum of INR 25,000/- along with two sureties of the same amount, to the satisfaction of the concerned Jail Superintendent, Trial Court, or Duty Metropolitan Magistrate, and subject to the following conditions: (a) The Applicant shall surrender before the Jail Superintendent/Trial Court/ Duty MM, on or before the expiry of three weeks from the date of release; (b) The Applicant shall, under no circumstance, leave the NCT of Delhi, without permission of the Trial Court, during the period of his release; (c) The Applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case, in any manner whatsoever; This is a digitally signed order. The Order is downloaded from the DHC Server on 03/09/2025 at 11:53:08 (d) The Applicant shall provide the address where he would be residing after his release and shall not change the address without informing the concerned IO/ SHO; (e) The Applicant shall, upon his release, give his mobile number to the concerned IO/SHO and shall keep his mobile phone switched on at all times. (f) The Applicant shall not commit any offence during the period of his release. 8. In the event of there being any FIR/DD entry/complaint lodged against the Applicant, it would be open to the State to seek redressal by filing an application seeking cancellation of bail. 9. It is clarified that any observations made in the present order are for the purpose of deciding the present bail application and should not influence the outcome of the trial and shall also not be taken as an expression of opinion on the merits of the case. 10.
