Operative part
The present appeals are disposed of with the observations that the impugned judgments and decrees are sustained, however, in case the appellants makes a payment of Rs.26 lakhs to the respondents/plaintiffs in terms of para 7(d) of the settlement agreement dated 23.1.2012, the claims of the respondents/plaintiffs in these appeals as also in other legal proceedings shall stand satisfied. Both the parties shall remain bound by the terms and conditions as stated in the settlement agreement.
Since the appeals are compromised before the commencement of final arguments in the same, 50Yo of the Court fees paid in the appeals be refunded to the appellants in view of Section 164. of the Court Fees Act as applicable to Delhi.
