JUSTICE SUBRAMONIUM PRASADO R D E R% 29.10.20251.This is a petition under Section 34 of the Arbitration & Conciliation Act for setting aside the Arbitral Award dated 13.01.2025 passed by the learned Sole Arbitrator. 2.Learned Counsel for the parties in unison state that the parties have settled all their disputes in terms of Settlement Agreement dated 25.10.2025. 3.The Settlement Agreement dated 25.10.2025 reads as under:- “SETTLEMENT AGREEMENT This agreement is entered and signed at New Delhi on 25th day of October, 2025. WHEREAS: A. THE First Party and Second Party entered into a lease deed ("Lease Deed") duly registered with the concerned Sub Registrar, on 22.02.2022 for the Second Floor, at 20, Anand Lok, August Kranti Marg, New Delhi ("Leased Premises") for a period of five years. B. There were inter-se differences, and the First Party instituted a complaint (No. CC NI Act/5857/2022) before the Ld. Metropolitan Magistrate, South-East District, Saket Court, under the Negotiable Instruments Act, 1881 ( "Criminal Complaint”) and the Second Party has filed a petition (Crl. M. C. No. 6913 of 2022 titled “J Law Offices vs Vindu Goenka”) before the Hon’ble Delhi High Court for quashing of the Criminal Complaint. C. The inter-se disputes were referred to sole arbitrator appointed by the Hon’ble Delhi High Court, who gave an Award dated 13.01.2025, for Rs.7,10,700/- in favour of the 2nd party. No.4 of 2025 titled “J Law Offices vs Vindu Goenka” before the Hon’ble Delhi High Court under Section 34 of the Arbitration and Conciliation Act 1996. E. The Second Party has also filed an Execution Petition (bearing No. Ex. Comm Award No.36 of 2025 titled “J Law Offices vs Vindu Goenka”) before the District Judge, Commercial, South District, Saket Court under Section 36 of the Arbitration & Conciliation Act, 1996 challenging the arbitral award. F. During the pendency of the above proceedings, and with a view to amicably resolve the inter-se disputes & litigation, the Parties held discussions in the presence of their respective Advocates. Based on discussions and without any undue influence or coercion and out of their own free will, the Parties have agreed to amicably resolve/ settle all their disputes and differences in good faith. NOW THEREFORE, IT IS AGREED BETWEEN THE PARTIES AS FOLLOWS:- I. The First Party agrees to pay an all-inclusive one-time and overall settlement amount of Rs. 20,00,000/- (Rupees Twenty Lakhs Only) inclusive of all taxes to the Second Party by way of Demand Draft bearing No.657338 dated 23.10.2025 drawn on HDFC First Bank purchased by Mrs. Vindu Goenka in the name of J Law Offices. No. 4 of 2025 titled “J Law Offices vs Vindu Goenka”, and pray for Orders, to take this Settlement Agreement on record and dispose off the petition, in terms of the Settlement Agreement. The Settlement Amount by way of Demand Draft/Pay Order, shall be handed over to the Second Party in the High Court, when the joint application is taken up by the Hon’ble Delhi High Court. 3. That initially the Second Party shall file a copy of the order withdrawing OMP no.04 of 2025 issued by this H’ble Court then the second Party shall withdraw Ex. Comm Award No. 36 of 2025 titled “J Law Offices vs Vindu Goenka” filed before the Ld. District Judge (Commercial Court) South District, Saket, New Delhi. 4. Thereafter the First Party shall file a copy of the Orders issued by the Hon’ble Delhi High Court (in O.M.P. No. 4 of 2025), in Criminal Complaint pending before the Ld. Metropolitan Magistrate, South-East District, Saket Courts, New Delhi and withdraw the Criminal Complaint. 5. Upon withdrawal of the Criminal Complaint by the First Party, the Second Party shall withdraw Crl. M.C. No. 6913 of 2022 titled “J Law Offices vs Vindu Goenka” pending before the Hon’ble Delhi High Court. 6. Upon execution of the Settlement Agreement, neither Party shall have any subsisting right or claim against the other Party, in relation to the Lease Deed and any disputes/differences arising out of its termination, and both Parties irrevocably and conclusively releases, waives, discharges, any and all of its claims, demands, rights, disputes, differences, claims, liabilities, claim of damages/ costs/ expenses, obligations etc., against the This is a digitally signed order.
