CORAM: HON'BLE MR. JUSTICE TUSHAR RAO GEDELA O R D E R % 06.06.2025 1. This is an application filed under Section 439 for grant of Interim Bail for a period of 30 days in case FIR No. 882/2015, P.S. Nihal Vihar, under Section 302/307/120-B/34 IPC. 2. As per the nominal roll, the applicant is an under trial. This Court has also perused the medical report dated 03.06.2025. 3. Having regard to the nature of the medical report, it would be apposite to extract the same hereunder:- “Sub: Medical report of Inmate/Patient Manish S/o Manohar Lal. With Reference to the order of HON'BLE HIGH COURT OF MR. JUSTICE SANJEEV NARULA, Delhi, seeking medical report of aforesaid inmate patient to be submitted as per date given. As per available medical records inmate patient is lodged in CJ-8/9. Inmate patient is a follow up case of Cholelithiasis, Right Contracted kidney and CKD-03 (Chronic Kidney Disease) under treatment from DDU Hospital, RML Hospital, AIIMS Hospital. On multiple occasions inmate patient was reviewed and examined on every visit by jail duty doctors for his symptomatic complaints, he was advised This is a digitally signed order. On 18.11.2024 inmate patient was sent to AIIMS hospital DMSA Scan which reveals right kidney contracted in size and only 6% functioning with mild global impairment, mildly impaired functioning left kidney with non obstructive clearance, small size left kidney with poor function. On 05.12.2024 inmate patient was sent to AIIMS Hospital, Nephrology Department as case of gall bladder stone disease. He was examined and advised BP charting and medications accordingly in view of his high blood pressure. On 28.04.2025 inmate patient was sent to AIIMS department, Nephrology, Department. He was examined and advised to avoid NSAIDS, low salt, blood investigations, USG KUB and medications accordingly. His USG whole abdomen was done on 01.05.2025 at DDU Hospital which revealed Cholelithiasis and Echogenic small right kidney. His USG KUB is scheduled on 30.10.2025 as per date given by AIIMS Hospital. He is also given laboratory appointment on 21.07.2025 by AIIMS Hospital. He is scheduled for the same and is being provided all the medications from jail dispensary. On 08.05.2025 and 15.05.2025 inmate patient presented in dispensary for follow as a case of gall bladder stone disease with CKD (Chronic Kidney Disease) with right shrunken kidney. His blood investigations revealed high Creatinine level 2.0 on 08.05.2025. He was examined by jail duty doctor and was provided prescribed medications accordingly. It is to be submitted the the inmate patient was sent to AIIMS Hospital on 27.05.2025 in compliance of Hon'ble court order for prepone of required tests and the same was preponed by AIIMS Hospital for 29.05.2025 and 02.06.2025. On 29.05.2025 inmate patient was sent to AIIMS Hospital for ultrasound and blood sampling as per appointment and the same was done. On 02.06.2025 inmate patient was sent to AIIMS Hospital, Nephrology Department for review with reports. He was examined as a known case of Right Contracted kidney and CKD-3a (Chronic Kidney Disease) and Gall Stone Disease. He was advised medications accordingly and dietary modification. Inmate patient is being provided all the medications as prescribed. This is for your kind information and further submission to the Hon'ble High Court.” This is a digitally signed order. It has been informed that the applicant has been given a date of 21.07.2025 for KUB Examination pertaining to the Chronic Kidney Disease by the All Indian Institute of Medical Sciences and 21.10.2025 for the Ultra Sound in respect of Cholelithiasis. 5. In the meanwhile, from the medical report, it appears that the applicant is being only given painkillers to sustain the pain. However, the Jail Hospital is incapable of conducting such surgeries. Learned Counsel for the applicant submits that the applicant would attempt to undergo the required surgeries in a private hospital. 6. Keeping in view the aforesaid serious medical condition of the applicant, it is deemed appropriate to enlarge the applicant on interim bail on medical grounds for a period of 30 days from today, subject to the petitoner furnishing the personal bond of Rs. 50,000/- with one surety of the like amount to the satisfaction of the learned Trial Court/ Duty MM, on the following conditions:- a) The applicant shall surrender his passport, if any, to the Court concerned and shall under no circumstances leave Delhi-NCR without prior permission of the Court concerned; b) The applicant shall not indulge in any criminal activity of any nature whatsoever; and c) The applicant shall provide his mobile number(s) to the Investigating Officer and keep it operational at all times. d) The applicant shall furnish copies of the medical documents/reports/status every week without fail to the IO.
