JUSTICE SWARANA KANTA SHARMA O R D E R% 22.05.2025 1.By way of the present writ petition, the petitioner seeks the following reliefs: “a. issue writ, order or direction in the nature of mandamus commanding the Respondents No. 1 and 2 to provide the police protection to the petitioner against any attack, assault or any act of causing physical and mental injuries to the petitioners by or on behalf respondent no.3 to 11 and their family members, companion, relatives, agents etc. b. Direct the Respondent No.1 and 2 to refrain from troubling and threatening the Petitioners at the instance of Respondent Nos. 3 to 11 and to follow the settled legal positions. c. Direct the Respondent No.1 to safeguard the life and liberty of the Petitioner and to ensure that the Petitioner is not implicated in false cases and are not harassed for all times to come on this issue. d. Direct the Respondent Nos. 3 to 11 to refrain from getting This is a digitally signed order. The Order is downloaded from the DHC Server on 02/07/2025 at 00:28:00 indulging into any illegal activities and not to cause any harm to the lives and liberty of the Petitioner.” 2.Briefly stated the facts of the present case are that on 12.05.2025 at around 10 PM, the petitioner’s son had gone to buy biscuits and when he was returning, two boys were fighting with each other in front of her house. After watching them for a long time, the crowd had gathered and no one stopped the fight. As it was a neighbor's fight, the son of the petitioner had started mediating. It was known that both of them, one whose name is Vinod and the other is Kanhiya, were fighting with each other over a cigarette. While the petitioner’s son was mediating, Vinod attacked Kanhiya with the bracelet on his hand due to which Kanhiya had started bleeding profusely, after which Vinod had fled from the spot and Kanhiya had also gone to his home. Later it was found out that Kanhiya's family had taken him to the hospital for treatment and later he returned home. Thereafter, petitioner’s son had come home. Later on the next day between 03:30 to 04:00 AM, all the people from Kanhiya's house and many other people with them had come to the house of the petitioner and had attacked at the petitioner house and had started vandalizing the house and attacking with stones. Out of fear petitioner had not come out of the house. All the people who had attacked the house, had broken the window grills and had started pelting stones inside the window. One of the stones hit petitioner’s head due to which she had started bleeding and during this time they had broken the outside wooden door of the petitioner’s house and the petitioner had gone inside and hid in a room. The son of the petitioner had made a PCR call and they were taken to Raghubir Nagar Police Post. When the police had taken the petitioner’s son away, the petitioner had reached the police station and had asked the reason, This is a digitally signed order. On 14.05.2025, respondents no. 3 to 11, had come to the house of the petitioner and had started pelting stones at her house. On 16.05.2025, the said persons had come to the house of the petitioner and had set fire on the petitioner’s scooter. All the above respondents had again gathered and had come back to the petitioner’s house and had started trying to occupy the house of the petitioner by breaking up the lock of the house. The information of the abovesaid incidents had been given to the concerned police but no action has been taken. Hence the petitioner is constrained to file the present writ petition. 3.Issue notice. The learned ASC for the State accepts notice on behalf of respondents no. 1 to 3. 4.This Court has heard the submissions on behalf of petitioner as well as the State and has perused the material available on record. 5.Considering the overall facts and circumstances of the case, and the fact that petitioner has prayed for protection of her and her family’s life as they are apprehending threat from respondents no. 3 to 11, the petitioner is directed to provide her mobile number to the concerned Investigating Officer and SHO. Similarly, the mobile numbers of concerned IO, SHO and beat constable be also shared with the petitioner. 6.The officials of Police Station Khyala, Delhi including SHO are directed to provide adequate protection to the petitioner from the above-mentioned persons, in case such circumstances arise, immediately upon being contacted. 7.The learned counsel appearing for petitioner states that he is satisfied with the aforesaid arrangement.
