JUSTICE TUSHAR RAO GEDELAO R D E R% 21.05.20251.Heard the petitioner in person and learned counsel representing the respondent nos. 1 and 2. 2.The primary grievance raised in this public interest litigation petition is in respect of making available the public amenity of Piped Natural Gas (hereinafter referred to as ‘PNG’) facility in all the feasible areas of Delhi villages. 3.Apart from the said grievance, certain other grievances have also been raised, which are reflected in the prayer clause of the writ petition, which is extracted herein below:- “i This Hon’ble Court may kindly issue a Writ of mandamus thereby mandating the respondents to provide public amenity of PNG facility in all feasible areas of the Delhi Villages and submit a status report This is a digitally signed order. The Order is downloaded from the DHC Server on 01/07/2025 at 20:03:31 within 30 days on PNG infrastructure progress in Delhi villages, including village-wise data on households served and left unserved of this public facility in Delhi; ii. This Hon’ble Court may kindly issue a Writ of mandamus thereby mandating the respondent no.2 to update the Geo Spatial Delhi Limited (GSDL) mapping of IGL pipeline routes extended in Delhi village boundaries in 30 days and submit compliance report; iii. This Hon’ble Court may kindly issue a Writ of mandamus thereby mandating all the Respondents to immediately submit the copy of the Memorandum of Understanding (MoU) signed between the Respondents in the Hon’ble Court. iv. This Hon’ble Court may kindly issue an appropriate writ, order, or direction to Respondents to frame and publish a time-bound, area-wise Standard Operating Procedure (SOP) for ensuring domestic piped gas coverage reaches in all unserved Delhi villages and respondents shall submit a compliance plan with specific deadlines for each remaining Delhi village; v. This Hon’ble Court may kindly Direct Respondent No. 3 to ensure that application forms, grievance redressal processes, display boards and outreach materials are available in both Hindi and English, in accordance with constitutional provisions and principles of linguistic inclusion for ensuring accessibility for village residents; vi. This Hon’ble Court may kindly Direct Respondents to establish a Village PNG Concessionary Scheme within 60 days, providing financial relaxation and subsidized connection fees to villagers in light of the historical denial of service for more than two decades; vii. This Hon’ble Court may kindly direct the respondents to constitute an independent monitoring committee, including village representatives and experts, to investigate the delays, check the interdepartmental coordination and oversee PNG implementation work in Delhi villages and report progress to this Hon’ble Court; viii. This Hon’ble Court may kindly issue Direct the Respondent No.1 and the Respondent No.2 to submit audit report of dividend receipts and re-investment in PNG infrastructure in villages of Delhi; ix. This Hon’ble Court may kindly direct the respondents to complete the repair and remediation of roads and public areas affected by pipeline digging in the identified villages and submit compliance This is a digitally signed order. This Hon’ble Court may award the costs, damages, and litigation expenses to the Petitioners to further the cause of protection of public interests and to continue their efforts to strengthen public spirited inquiries to end similar unjustified exclusions of citizens. xi. And pass such other or further order or orders as this Hon’ble Court may deem fit in the interests of Justice / Equity and proper in the facts and circumstances of the case.” 4.Each prayer made in this petition, in our considered opinion arises out of distinct and separate cause of action and as such trying such a PIL becomes difficult and accordingly, the petitioner would be better advised to take up each individual causes separately. Even otherwise, the grievances of the petitioner raised in this writ petition ought to be brought to the notice of the authorities concerned and accordingly, so far as the prayer made in the petition for issuing a direction to provide the public amenity of the PNG facility to Delhi villages is concerned, we provide that the petitioner shall raise his grievances with the respondent no.3 by way of making an appropriate representation taking all the pleas which may be available to the petitioner. 5.The said representation shall be made within a fortnight from today and in case, any such representation is made, the same shall be considered and an appropriate decision thereon shall be taken by passing a reasoned and speaking order by the Competent Authority of respondent no.2 within 02 months thereafter. The decision to be taken under this order shall be communicated to the petitioner. 6.In case, the petitioner still feels aggrieved by such decision to be taken under this order by respondent no.2, he will be at liberty to take recourse to the legal remedy/remedies which may be available to him under This is a digitally signed order. The petitioner is thus permitted to make a representation to the authority concerned in respect of the other grievances within a fortnight from today and in case, any such grievance is raised by way of making a representation, the same shall be considered and an appropriate decision thereon shall also be taken. In case, the authority on going through the representation comes to the conclusion that some action is warranted under law, the same shall also be considered by the authority concerned with due expedition. 8.The present petition along with pending application stands disposed of in view of the aforesaid terms.
