The present writ petition (Criminal) under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) has been filed by the petitioners for directing the State to provide adequate protection to the petitioners from the hands of respondent Nos. 2 to 5. 2. It is stated that the officials respondent No.1 are well aware that the petitioners are not only facing physical and mental torture everyday at the hands of respondent No.2, i.e., the mother of the daughter-in-law of the petitioners, who is a responsible officer at Delhi Police and expected to be a law protector. 3. It is submitted that the petitioners are apprehending their lives and This is a digitally signed order. The respondent No.5 who is the brother of respondent No.2 had over powered the Lalit Kumar son of the petitioner whose marriage was solemnized with respondent No.4 being daughter of respondent No. 2 and 3. 4. The petitioner No.1 has retired from DDA and after his retirement he is leading a peaceful life with his wife in his house at Burari, Delhi. He has given first floor to his younger son Lalit Kumar and second floor to his elder son Dinesh Kumar for residence so that they both may be able to lead their happy married life. 5. The petitioner’s younger son Lalit Kumar got married to respondent No.4 on 22.04.2024 in a simple marriage ceremony. The respondent No.4 along with his son Lalit Kumar was living on first floor peacefully but after 15 days there was a temperamental differences arose between them. Then on the provocation of respondent no.2 and 3, respondent No.4 started compelling her husband (son of petitioners) to get executed title documents of the property in her name from the name of petitioners. Initially, the demand was ignored by the son of petitioners considering the same as a joke but when the respondent No.4 became serious and pressurizing him he reacted sharply which resulted into quarrel between the son of petitioners and Respondent No.4. It was the habit of Respondent No.4 has resulted informing the PCR and police personnel to visit their house. 6. The counsel for the petitioner submits that when the son of the petitioners became apprehensive towards his wife, respondent No.4 and Respondent Nos.2 and 3, then to protect himself he has given a written This is a digitally signed order. It is submitted that respondent Nos. 2, 3 and 5 are in the habit of reaching the house of the petitioners and overpowering them by using muscle power and also by using the power of the police. It is submitted that it was surprising to the petitioners when on the quarrel of their son and his wife/ Respondent No.4 on 06.11.2024 at about 10 PM, the respondent no.2, 3 and 5 alongwith other relatives visited the house of petitioners and son of the respondent no.2 namely Ritik slapped the petitioner no.1 and other persons also beaten the petitioners by which the petitioner No.1 received injuries in his ear and he was admitted to Dr. Baba Sahab Ambedkar Hospital Rohini at about on 07.11.2024. Instead of taking any action against the assailants the police threatened the petitioners and their son under the influence of respondent no.2 sent the son of petitioners and respondent no.4 to Delhi Government Mediation and Conciliation Centre where settlement was entered between Lalit Kumar son of the petitioners and respondent No.4. Despite settlement Lalit Kumar and respondent No.4 could not be able to live peacefully and calls had been made through PCR. It is the daily routine in their family as the PCR is being called regularly. It is therefore stated that there is a continuous threat to their lives and liberty at the hands of respondent who has been extending threats. Hence the Petition is filed seeking protection to be provided by the police. 8. Learned counsel for the State submits that it is a family matter and whenever the PCR is called it reaches promptly and discharge its duties in accordance with law. No further actions are required. 9. Submissions heard. 10. Essentially from the submissions made in the petitioner it emerges that it is a dispute between Lalit Kumar and his wife respondent No.4 on account of which petitioners feel threatened.
