The instant petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter “BNSS”) has been filed by the petitioner praying for quashing of FIR no. 284/2012 registered at Police Station Adarsh Nagar, for offences punishable under Sections 186/353/341/354/506/34 of the Indian Penal Code, 1860 (hereinafter “IPC”). 2. The brief facts of the case are that on 06.11.2012, respondent no. 2, a Lecturer of Sarvodaya Kanya Vidyalaya, Adarsh Nagar, alleging that while she was taking a class, the petitioners forcibly entered the classroom, misbehaved with her, subjected her to sexual harassment, used abusive This is a digitally signed order. She further stated in her complaint that similar acts of harassment and intimidation had been committed by the petitioners on earlier occasions as well. 3. Learned counsel appearing on behalf of the petitioners submitted that charges have been framed and the chargesheet has already been filed against the petitioners. It is submitted that the petitioners and respondent no. 2 have settled their disputes amicably and are now moving forward towards a peaceful and harmonious future. 4. Memorandum of Settlement deed dated 22.04.2025 is on record and has been annexed as “Annexure P-3”. Qua this deed, the respondent no. 2 has agreed to withdraw the case arising out of FIR No. 284/2012 registered at Police Station Adarsh Nagar against the petitioners. 5. It is prayed by the learned counsel appearing on behalf of the parties that the instant FIR may be quashed on the basis of the compromise. 6. Learned APP for the State, who appears on advance notice, accepts notice and submits that there is no opposition to the prayer made by the petitioners seeking quashing of the FIR in question in view of the settlement arrived at between the parties. 7. Heard learned counsel for the parties and perused the record. 8. The petitioners are present before this Court and have been identified by their counsel and Investigating Officer, Police Station Adarsh Nagar. Respondent no. 2 is also present in the Court and has been identified by her counsel and the Investigating Officer. 9. Ordinarily, allegations of such a nature would not warrant quashing of FIR. The allegations, as borne out from the record, are indeed grave, This is a digitally signed order. The Order is downloaded from the DHC Server on 20/09/2025 at 12:29:48 particularly as they pertain to acts committed within the precincts of an institution which is regarded as a temple of learning, where education, morals and values are imparted. Parents repose their faith by sending their children to such institutions to be nurtured in the path of knowledge and righteousness. The act, as alleged, assumes greater seriousness for the reason that it is committed upon a person who himself/herself is the imparter of education. 10. Nonetheless, since respondent no. 2 has unequivocally expressed her desire to forgive, not to pursue the matter further, and to move on with her life, this Court seems it appropriate to give quietus to the proceedings. 11. Also, on a query made by this Court, respondent no. 2 has categorically stated that she has entered into compromise of her own free will, without any coercion, undue influence or pressure. She further affirmed that the entire dispute has been amicably resolved between the parties. It is further stated by her that, pursuant to her complaint, the overall situation in the school improved, and eventually, the school, which was earlier co-educational, was converted into an all-girls institution. 12. Keeping in view the fact that the matter stands amicably settled between the petitioners and respondent no. 2, without any pressure, no fruitful purpose would be served by keeping the matter pending. 13. Hence, in light of the judgment of the Hon’ble Supreme Court passed in Gian Singh vs. State of Punjab (2012) 10 SCC 303, FIR no. 284/2012 registered at Police Station Adarsh Nagar, for offences punishable under Sections 186/353/341/354/506/34 of the IPC, and consequent proceedings emanating therefrom, are quashed qua the present petitioners, subject to the This is a digitally signed order. Petitioner No. 5 to perform two months of community service on every Saturday and Sunday at Deen Dayal Upadhyay Hospital, Hari Nagar, New Delhi-110064 Upon completion of the said period, a certificate confirming the completion of community service shall be issued by the Medical Superintendent of the concerned Hospitals and the same shall be filed with the Registry. In the event of any absenteeism, default, or misconduct on the part of the petitioners during the course of the community service, the same be immediately reported by the Medical Superintendent to the concerned SHO, who shall, in turn, inform the APP for placing the matter before this Court and seeking appropriate orders, including revival of the FIR.
