The present petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 seeks quashing of FIR No. 292/2019, under Sections 380/506 of the IPC registered at P.S. Neb Sarai, and all the other consequential proceedings emanating therefrom including the chargesheet pending before the Court of Ms. Nidhi Singh, learned JMFC-03, Saket Courts. 3. Learned counsel for the petitioner submits that the latter is daughter of respondent no. 2. With the intervention of friends, they have settled their disputes and, therefore, the present petition seeking quashing of FIR No. 292/2019, under Sections 380/506 of the IPC registered at P.S. An affidavit of No Objection Certificate dated 17.04.2025 has been placed on record (Annexure P-2), which records the settlement between the parties and their agreement to cooperate with each other in quashing the present FIR. 5. The petitioner and respondent no. 2/complainant have appeared in-person before the Court today and the parties have been duly identified by their respective counsels, as well as the Investigating Officer, SI Ganga Singh, PS Neb Sarai. 6. The matter was also placed before the learned Joint Registrar who has recorded the statements of both the parties on 25.04.2025, which reads as under: - “1. I am the Respondent no. 2 in the present petition. At my instance, FIR bearing no. 292/2019, Under Section 380/506 IPC was registered at PS Naib Sarai, Delhi against the petitioner. The case was thereafter transferred to DIU/SD, Delhi, The final report has been filed in this case and accused has been kept in column no. 12. 2. Petitioner is my real daughter. The relations between me and my daughter were strained leading to registration of abovesaid FIR. 3. Now, we have settled all our issues and disputes orally and 1 have given my affidavit of NOC for quashing of the abovesaid FIR which is on record as Annexure — P-2 at page no. 19-20 bearing my signatures. 4.I have no objections, if abovesaid FIR is quashed and I shall not raise any claim in this regard through any civil or criminal proceedings. 5. This is my true statement being made voluntarily in the presence of IO. I fully understand the consequences of making this statement. 1 have put my thumb impression on this statement in the presence of 10 after the same has been read over to me in Hindi. 7. The complainant/respondent No.2 states that the matter has been settled with the petitioner and she has no objection if the FIR is quashed against the petitioner. 8. Learned APP for the State has no objection, if the present FIR and the chargesheet pending before the Court of competent jurisdiction is quashed. 9. In Gian Singh v. State of Punjab, (2012) 10 SCC 303, the Hon’ble Supreme Court has recognized the need of amicable resolution of disputes by observing as under:- “61. ... In other words, the High Court must consider whether it would be unfair or contrary to the interest of justice to continue with the criminal proceedings or continuation of criminal proceedings would tantamount to abuse of process of law despite settlement and compromise between the victim and the wrongdoer and whether to secure the ends of justice, it is appropriate that criminal case is put to an end and if the answer to the above question(s) is in the affirmative, the High Court shall be well within its jurisdiction to quash the criminal proceeding.” 10. In view of the aforesaid circumstances, and the fact that the parties have put a quietus to the dispute, no useful purpose will be served in continuing with the present FIR No. 292/2019, under Sections 380/506 of the IPC registered at P.S. Neb Sarai, and all the other consequential proceedings emanating therefrom including the chargesheet pending before the Court of competent jurisdiction. 11. In the interest of justice, the petition is allowed, and the FIR No. 292/2019, under Sections 380/506 of the IPC registered at P.S. Neb Sarai, and all the other consequential proceedings emanating therefrom, including the chargesheet pending before the Court of Court of Ms. Nidhi Singh, learned JMFC-03, Saket Courts is hereby quashed.
