Mr, ri.L, TIkku, Sr. Advocate with Ms. Yashmeet,, Advocate for the respondent. +QMP NO.59/20Q4 * After some hearing ieamed counsei for the petitioner states that he has obtained instructions that he does not want to press this petition under Section 34 of the Arbitration and Conciliation Act 1996. The result of this would be that the award becomes executable as a decree and needless to say applies in so far as para (iv) of para 80 is concerned to the extent that the petitioner shall abide by the undertaking as specified in the award. It is, however, agreed that if the petitioner makes the following payment in the manner provided. the decree shall be deemed to be satisfied and no further amounts under the award shall be claimed by the respondent: 1) The petitioner shall pay to the respondent a sum of Rs.16,00,000/- within 7 days from today I.e. on or before 21®' November, 2005. 2) The petitioner shall pay to the respondent a further sum of Rs.16,00,000/- within three months from today i.e. on or before 14"^ February, 2006. The petition stands disposed of in terms aforesaid.
