HON'BLE MR. JUSTICE SANJAY KISHAN KAUL HON'BLE MR. JUSTICE RAJIV SHAKDHER % ORDER
14.03.2012 t Rule D.B. Learned counsel for the respondents accepts notice. At request of learned counsels for the parties the petitions are taken up for final disposal. These are another set of cases arising from the order of the Delhi Co- W.P.(C) 1060-1064/2012 Page2of4 M operative Tribunal (DCT) which have been passed without any applijcation of mind. There is complete absence of reasoning. It appears that the appeal has been extracted verbatim followed by the written synopsis of the respondents and the conclusion only states that: given facts of the case this order is being passed. We have been constrained to take note of such a practice followed by the DCT, in WP(C) No. 1207/2012, decided on 29.02.2012. We have set aside the order passed by the DCT for the same reason, and have also proceeded to issue general directions and called upon the standing counsel of GNCT of Delhi to place before us the position about the staff strength of the DCT as also the position qua the orderspassed in the lastiWc months. The order in the present case also similarly runs into almost 21 pages, out of which purported findings are set out only in the last paragraph which reads as follows : "...considering all facts and circumstances, submissions and legal provisions in mind the bench is of the view Ld. JR has wrongly rejected the claim of appellant u/s 70 of Delhi Cooperative Societies Act 2003. Therefore, the bench accepts the appeal and the impugned order of JR bearing no. 917/918/919/920/922/ JR/Arb./2010-l 1/1639 dated 27-10-2010 are set aside. In view of this, the matter falls within the provision of section 71 of the DCS Act, 2003 to be referred to adjudication. No order as to cost. " We have thus no hesitation in setting aside the impugned order dated
19.12.2011 and making the rule absolute. The parties to appear before the DCT on
