The present petitions seek quashing of complaints under Section 138 of Negotiable Instruments Act, 18811 filed against the Petitioners, along with all proceedings emanating therefrom, including the summoning orders. 2. On the first date that the matter was taken up, the Court had directed service of advance copies of the petitions on the Respondents, who have now appeared and are represented by counsels. 3. Counsel for the Respondents has drawn the attention of this Court to the order dated 28th March, 2022, passed by the Supreme Court in W.P. (C) No. 300/2020, dismissing a petition filed by the Petitioners, raising the same grounds and seeking similar prayers for quashing of the criminal complaints against them. 4. It is pertinent to note that the Petitioners have failed to disclose the existence or outcome of the said proceedings before the Supreme Court in any of the captioned petitions. In the considered view of this Court, such omission constitutes material suppression and amounts to an abuse of the process of law. 5. Upon being confronted with the above, counsel for the Petitioners tenders an unqualified apology to the Court and submits that the earlier proceedings and the order of the Supreme Court were not brought to his knowledge. It is stated that no instructions or information to this effect were ever shared with him by the Petitioners. Nonetheless, counsel seeks permission to withdraw the present petitions and reiterates his regret for the This is a digitally signed order. While this Court has no reason to disbelieve the statement of the counsel, and is inclined to accept his request to withdraw the petitions, the nature of the suppression, concerning binding judicial proceedings before the Apex Court, is too serious to permit a withdrawal without consequence. In the opinion of the Court, at the very least, imposition of costs is warranted to mark its disapproval of the Petitioners’ conduct and to deter such attempts at misleading the Court. 7. Accordingly, the present petitions are dismissed as withdrawn, subject to payment of costs of ₹10,000/- per petition, to be deposited with the Delhi State Legal Services Authority within a period of four weeks from today.
