ThecaseofthePetitioneristhathisfatherusedtosquatandrunakioskneartheofficeoftheRegistrarofCooperativeSocieties, ParliamentStreet, NewDelhi(hereinafter,‘thesite’).
ThePetitionerisstatedtohavebeenvendingfromthesitesince2000.However, sometimein1976,hisfatherwasalsoofferedakioskatKrishiBhawan, whichdidnotmaterialise.
Presently, the Petitionerissellingcholekulchefromthesite. ThegrievanceofthePetitionerinthepresentpetitionisthathewasnotsurveyed This is a digitally signed order. Underthesecircumstances, theonlyorderthatcanbepassedisthatthePetitionerwouldbepermittedtopursuehisclaimsunderSection4(2)oftheStreetVendors(ProtectionofLivelihoodandRegulationofStreetVending)Act2014,ifanysurveyisbeingconductedbytheTownVendingCommittee, inthefuture. Thesameshallbedealtwithinaccordancewithlaw. ThevalidityorgenuinityoftheclaimsofthePetitioner, havenotbeenverifiedbytheCourt.
