Petitions under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as ‘B.N.S.S.’), have been filed on behalf of the Petitioners, for quashing/setting aside the Impugned cognizance/Summoning Order dated 02.12.2024 arising out of FIR No. 487/2024 dated 03.10.2024 under Section 125(A)/106(1) of the Bharatiya Nyaya Sanhita, 2023 (hereinafter referred to as ‘BNS’) registered at Police Station Kalkaji including the Charge Sheet dated 30.11.2024 and all the consequential proceedings emanating therefrom. 2. Issue Notice. 3. On advance Notice, learned APP has appeared and accepted the Notice on behalf of the State. 4. In the Petition bearing CRL.M.C. 674/2025, the Petitioner, namely, Mahant Surender Nath is the Mahant/Baridar in the Kalkaji Temple situated at Kalkaji, New Delhi. In the Petition bearing CRL.M.C. 1804/2025, the Petitioner No. 1, namely, Mr. Hemant Bhardwaj was the President of Shri Kalkaji Mandir Prabandhak Sudhar Committee and Petitioner No. 2, namely, Mr. Lokesh Bhardwaj was the General Secretrary of the said Committee. In the Petition bearing CRL.M.C. 2328/2025, the Petitioner No. 1, Mr. Akhil Kumar @ Sagar is a firm beliver of Kalka Mata Temple and Mr. Raju Sharma, Petitioner No. 2 is an electrician at Kalkaji Temple. 5. Mayank, Respondent No. 6 is a minor, who is represented through his mother, Respondent No. 5, namely, Ms. Priyanka. Respondent No. 4, Babu has joined through Video Conferencing as he is in Bangalore. Other parties are present in person. 6. As per the case of the Prosecution, in the night of 02/03.10.2024 at about 10.00 PM, there was a huge line of people to visit Kalkaji Mandir when the electricity wire snapped leading to demise of Mayank Sharma, aged about 15.5 years, who was the son of Respondent No.2, namely, Mr. Ram Kumar and the Respondent No. 3, Ms. Sunita while there was 07 other persons, who suffered injuries to whom compensation as stated below, has already been given:-Because of electrocution, one child 15½ years old, Mayank had died. It is stated that the Petitioners and the Respondent No. 2 to 9 have amicably settled all their disputes and differences between them and arrived at Settlement. There were six other injured, namely, Babu, to whom Rs.11,000/- has been paid by the Petitioners.. He has appeared through VC and endorsed with having received the amount. Ms. Priyanka is present in the Court, who has received Rs.21,000/- for herself and for the injury to her minor son Rs.21,000/- also by the Petitioners. Mr. Lakhan, who is present in the Court in person along with his mother, namely, Ms. Kamla @ Pinki, This is a digitally signed order. The parties are present before this Court in-person today, and have been identified by their Counsel and Investigating Officer concerned and they have entered into the Settlement voluntarily and without any fear and coercion and undertake to remain bound by the terms of the said Settlement. 12. Considering the nature of the allegations and that they have settled the matter, the FIR No. 487/2024 dated 03.10.2024 under Section 125(A)/106(1) of BNS, registered at Police Station Kalkaji and all the consequential proceedings emanating therefrom are quashed. 13.
