This petition has been preferred by petitioners under Article 226 of the Constitution of India seeking following reliefs:- “10.1 That, this Hon’ble Court may kindly be pleased to call for the entire records pertaining to the case of petitioners.

10.2 That, this Hon’ble Court may kindly be pleased to allow the writ petition and quash the order dated 24.03.2022 (Annexure-P/1), 27.09.2021 (Annexure-P/2) and 17.02.2022 (Annexure-P/3) in the interest of justice.

10.3 Any other relief, which may deem fit and proper in the facts and circumstances of the case, may also be allowed.”

Learned counsel for the petitioner submits that petitioner has filed this writ petition against the order dated 17.02.2022 (Annexure-P/3) passed by the Commissioner, Durg Division, Durg (C.G.), he may be permitted to approach before the State for seeking redressal of his grievances.

Learned counsel appearing for the respective respondents have not raised any objection.

I have heard learned counsel for the respective parties and perused the material available on record.

As the dispute is related to grant of ‘Patta’, which has been granted to the petitioner, however, the revenue authorities are holding that the ‘Patta’, which has been granted to the petitioner is not maintainable, therefore, the petitioner has to approach before the concerned authorities having alternative remedy under the law. 3

Operative part

Considering the aforesaid aspect of the matter, this petition is disposed of, directing petitioner to approach before the concerned authorities against the order dated 17.02.2022 (Annexure-P/3) passed by the Commissioner, Durg Division, Durg (C.G.) by which the Patta granted in favour of the petitioner has been held to be bad in law.

With aforesaid observation and direction, this writ petition stands disposed of.
