Instant writ petition under Article 226 of the Constitution of India has been preferred by the petitioner seeking following reliefs :- “10.1 Hon'ble Court may kindly be pleased to call for the entire record pertaining to the instant case.
10.2 The Hon'ble Cout may kindly be pleased to allow this petition and direct the respondents not to construct wall closing the access road of petrol pump / petitioner and alternatively consider to construct cattle catcher, in the interest of justice. 2
10.3 Any other relief which the Hon'ble Court deems fit and proper in the facts and circumstances of the case may also be provided to the petitioner
Learned counsel appearing for the petitioner would submit that the petitioner has been granted license for running Indian Oil Petrol pump on the land bearing Khasra No. 358/3 and 364/3, total area 0.154 hectare in name and style of M/s Banke Bihari Kisan Kendra (KSK) at village Sakri, Block Dharsiwa, District Raipur. He further submitted that respondents authorities are raising 4 feet wall on the by-pass road, which prevents the vehicle moving on main road to access the petrol pump via by pass road. It is contended that petitioner has filed representation (Annexure P-3) dated 01.12.2024 before respondent authorities, but the same has not been considered and decided yet, therefore, learned counsel appearing for the petitioner submits that this petition may be disposed of directing respondent authorities to consider & decide the representation (AnnexureP-3) within a specific time frame.
Learned counsel appearing for the State has no objection to allow the limited prayer made by counsel for the petitioner.
Having considered the limited prayer made by counsel for the petitioner, the same is allowed. The respondent authorities are directed to consider and decide the representation (Annexure P-3) dated 01.12.2024 expeditiously preferably within a period of 30 days from the date of receipt of certified copy of this order.
