The appellant has filed the instant appeal under Section 19 (1) of the Family Court Act, 1984 against the impugned judgment & decree dated 28.04.2008 passed in Civil Suit No. 30-A/2023 passed by the learned Family Court, Surajpur, District- Surajpur (C.G.), whereby the learned Family Court allowed the petition under Section 13 (1) (ia) of Hindu 2 Marriage Act for decree of divorce and dissolved the marriage between the parties. Therefore, the present appeal filed by the appellant. 2. During the pendency of appeal both the parties agreed for amicable settlement and vide order dated 28.02.2025, the matter was referred to Mediation Centre of this Court and both parties have settled their dispute before the Mediation Centre on 19.03.2025, wherein statements of both the parties got recorded and compromise was arrived at between the parties in terms of the settlement agreement dated 18.03.2025, which was duly signed by them. 3. Operative paras of settlement agreement dated 18.03.2025 are as under:- “ दोनों प्ቌों का वि(cid:10)(cid:10)ाह 28.04.2008 को विहन्दू वि(cid:10)धि(cid:15) से सम्प्ቐ हुआ। वि(cid:10)(cid:10)ाह उपरांत अपीलाቕኍ(cid:31) ्ቦीमती रीना हस्तगेन वि(cid:10)दा होकर ्ቚधित(cid:10)ादी ्ቦी गौतम हस्तमेन के घर मनेन््ቖगढ़ आ गई इस दौरान एक पु्ቔी आलिलया हस्तगेन का जन्म हुआ जो बत1मान में ्ቚधित(cid:10)ादी ्ቦी गौतम हस्तगेन के साቕኍ विन(cid:10)ास करती है। आपसी सामजस्य ना होने के कारण आखरी बार पत्नी अ्ቚैल 2020 पधित के साቕኍ में रही तቕኍा उसके प्ቐात् ससुराल छोड दी तत्प्ቐात अपीलाቕኍ(cid:31) ्ቦीमती रीना हस्तमेन न्यु माईनस कालोनी भटगां(cid:10) जिजला सूरजपुर में विन(cid:10)ासरत है। अपीलाቕኍ(cid:31) ्ቦीमती रीना हस्तगेन ने तलाक का मुकदमा लगा कर विदनांक 08.10.2024 को तलाक की धिड्ቅी ्ቚा् कर ली। उभय प्ቌ के बीच साቕኍ रहने की कोई भी परिरቝኌस्ቕኍधित शेष नहीं रह गई और (cid:10)त1मान में भी कोई परिरቝኌस्ቕኍधित विनኌमत नहीं हो सकती अतः दोनो प्ቌ आपसी सहमती से (cid:10)ै(cid:10)ाविहक संबं(cid:15) जो वि(cid:10)(cid:10)ाह विदनांक 28.04.2008 को संप्ቐ हुआ जोविक विनम्नलिललिखत शतJ पर समा् कर रहे है। 1. यह विक ्ቚधित(cid:10)ादी ्ቦी गौतम हस्तगेन अपीलाቕኍ(cid:31) ्ቦीमती रीना हस्तगेन को एक मुस्त राशिश 3,00,000/- ( तीन लाख रूपये मा्ቔ) 50,000/- ( पचास हजार रूपये मा्ቔ) छः विकस्तों में ्ቚदान करेंगा। जिजसका ्ቚቕኍम विकस्त से 20.09.2025 के माह जिसतम्बर विदनांक 10.09.2025 बीच अपीलाቕኍ(cid:31) ्ቦीमती रीना हस्तगेन के स्टेड बैंक शाखा भटगां(cid:10) जिजला सूरजपुर के खाता ्ቅ 41433230652 छः- छः मविहनो में 50,000/- ( में जमा करेंगां। ए(cid:10)ं आगे की पांच विकस्त ्ቚቕኍम विकस्तो का भुकतान कमश से 20 तारीख पचास हजार रूपये मा्ቔ) के अ(cid:10)धि(cid:15) में माह के 10 के बीच अपीलाቕኍ(cid:31) ्ቦीमती रीना हस्तगेन के स्टेड बैंक शाखा भटगां(cid:10) जिजला सूरजपुर के खाता ्ቅ. 41433230652 में जमा करता रहेगा। 2. यह विक ्ቚधित(cid:10)ादी ्ቦी गौतम हस्तगेन अपीलाቕኍ(cid:31) ्ቦीमती रोना हस्तमेन के मध्य पू(cid:10)1 में कु टु ंब न्यायालय जिजला सुरजपुर छ o ग० में (cid:15)ारा 125 द.्ቚ. स के ्ቚकरण में जो ्ቦीतमी रीना हस्तगेन ए(cid:10) उनकी पु्ቔी आलिलया हस्तमेन के ्ቛारा ्ቚस्तुत विकया गया ቕኍा जिजसका वि(cid:10)वि(cid:10)(cid:15) ्ቚकरण ्ቅ 252/2021 है उका ्ቚकरण में माननीय न्यायालय ्ቛारा पु्ቔी आलया हस्तगेन को 2000/- रूपये ्ቚधित माह भरण- पोषण की राशिश विदलाये जाने का आदेश पारिरत हुआ है। 3 ्ቚधित(cid:10)ादी ्ቦी गौतम हस्तगेन उ्ሹ भरण- पोषण 2000/- की राशिश ्ቚधित माह 10 तारिरख तक अपनी पु्ቔी आलिलया हस्तगेन को ्ቚदान करता रहेगा। 3. के पास, यह विक (cid:10)त1मान में अपीलाቕኍ(cid:31) ्ቦीमती रीना हस्तगेन न्यु गाईनस कालोनी, शु्ቅ(cid:10)ार बाजार भटगा(cid:10) जिजला सूरजपुर में विन(cid:10)ासरत है जो विक एस.ई.सी. एल भटगा(cid:10) की जमीन पर ्ቚधित(cid:10)ादी गौतम हस्तगेन ्ቛारा विनኌमत विकया गया है जिजसमे अपीलाቕኍ(cid:31) ्ቦीमती रीना हस्तगेन ए(cid:10)ं उनकी पु्ቔ आलिलया विन(cid:10)ास करेंगी। भवि(cid:10)ष्य में ्ቚधित(cid:10)ादी ्ቦी गौतम हस्तगेन का उ्ሹ मकान पर कोई भी अधि(cid:15)कार नही रहेगा ए(cid:10)ं ्ቦी गौतम हस्तगेन के ्ቛारा उ्ሹ मकान पर कोई भी दा(cid:10)ा ए(cid:10)ं आपलिS नहीं की जायेगी ए(cid:10)ं उ्ሹ संबं(cid:15) में एक शपቕኍ प्ቔ ्ቦी गौSम हस्तगेन के ्ቛारा अपीलाቕኍ(cid:31) ्ቦीमती रीना हस्तगेन के प्ቌ में एक स्ाह के अंदर विनस्पाविदत विकया जा(cid:10)ेगा। 4. यह विक अपीलाቕኍ(cid:31) रीना इस्तगेन ्ቛारा अपील क FA(MAT) No. 394/2024 (Smt. Reena Hastgen Vs. Shri Gautam Hastgen) को इस राजीनामा अनुसार माननीय उ्ሴ न्यायालय से (cid:10)ापस कर ले(cid:10)ेंगी जिजससे कु टुम्ब न्यायालय सूरजपुर जिजला सूरजपुर ्ቛारा व्य(cid:10)हार बाद क. 30-ए/2023 में पारिरत विनण1य / धिड्ቅी विदनांक 18.10.2023 यቕኍा(cid:10)त रहेगा। इस वि(cid:10)(cid:10)ाह वि(cid:10)च्छेद के प्ቐात् अपीलाቕኍ(cid:31) ्ቦीमती रीना हस्तमेन ए(cid:10)ं ्ቚधित(cid:10)ादी ्ቦी गौतम हस्तमेन आपस में कोई भी संबं(cid:15) नहीं रखेगे ए(cid:10)ं एक दूसरे के ्ቚधित काई भी बात समाज में, काय1स्ቕኍल पर और कही भी नहीं करेगे तቕኍा उभय प्ቌ भवि(cid:10)ष्य में कभी विकसी (cid:10)ै(cid:10)ाविहक अधि(cid:15)कार के संबं(cid:15) में कोई मांग या मुकदमा दायर नहीं करेंगें। उभयप्ቌ इस समझौता प्ቔ की शतJ से सहमत हैं ए(cid:10)ं पालन के लिलए कविटब्ቍ हैं समझौता प्ቔ में दी गई शतJ को उन्होंने अपनी स्(cid:10)यं की स्(cid:10)ेच्छापू(cid:10)1क सहमधित ए(cid:10)ं विबना विकसी दबा(cid:10), भय ए(cid:10)ं लालच के स्(cid:10)ीकार विकया गया है उभयप्ቌ ने इस समझौता प्ቔ की शतJ को पढ़ने (cid:10) समझने के प्ቐात अपनी स्(cid:10)तं्ቔ सहमधित से परस्पर एक- दूसरे की उपቝኌस्ቕኍधित में हस्ता्ቌर कर विनष्पाविदत विकया। विबलासपुर (छ.ग.) ्ቚቕኍम प्ቌ Sd/- वि्ቛतीय प्ቌ Sd/- Sd/- मध्यस्ቕኍ ’’ ( ्ቦी वि(cid:10)(cid:10)ेक िሺसघल) 4. Learned counsel for the parties jointly submit that the aforesaid agreement has been arrived at between the parties without any pressure or coercion, out of their own free will, whereby they have amicable resolved the dispute before the Mediation Centre of this Court and therefore, the present appeal may be disposed of in terms of the aforesaid agreement dated 18.03.2025. 4 5. We have heard learned counsel for the respective parties. 6. In view of the submissions made by learned counsel for the parties, the judgment and decree of divorce dated 08.10.2024 passed by learned Family Court, Surajpur is hereby affirmed and looking to the terms and conditions of their settlement agreement dated 18.03.2025, the present appeal is disposed of in terms of the said agreement. The said agreement will form part of this judgment. 7. Let a decree be drawn accordingly.
