This petition has been filed by the petitioner for the following prayer :- “It is, therefore, prayed that this Hon'ble Court may kindly be pleased to allow the petition, may kindly be pleased to quash the F.I.R. bearing no. 0324/2023 and contents mentioned against the petitioner in the charge-sheet (Annexure P/1(Colly)) along with all the subsequent criminal proceedings 2 arising out of the F.I.R. with respect to the petitioner, on the basis of settlement between the parties and further may kindly be pleased to acquit the petitioners from the aforementioned offences, in the interest of justice.” 2. Case of the prosecution, in brief, is that the complainant/respondent No.2, a scrap trader with an interest in OnLine investments, came into contact with the Petitioner via the Telegram messaging platform in January 2023. The Petitioner allegedly induced the complainant to invest in the share market, the Multi Commodity Exchange (MCX), and equities, promising substantial returns on investment. To facilitate this, the Petitioner shared investment IDs associated with the ‘Smile’ and ‘Elite’ applications and provided specific bank account details for the transfer of funds. Relying on these assurances, the complainant made significant financial investments through the provided platforms and accounts. However, despite these investments, the promised returns and profits were never received. Thereafter, the present FIR has been lodged by the respondent No.2/complainant. 3. Learned counsel for the petitioner submits that the petitioner is a juvenile and though the FIR was also registered against him along with five other co-accused persons, against whom the charge sheet has been submitted by the Police. So far as the petitioner is concerned, the investigation with respect to him is still pending and she submits that the matter has been compromised between the parties. She further submits that so far as the other co-accused 3 persons is concerned, the complainant has also agreed not to proceed against them as he has already received the money which was invested by him for share trading as it reflects from the compromise deed at Para-6. She further submits that the petitioner has been granted anticipatory bail by the trial Court on 16/04/2025. 4. Learned counsel for the respondent No.2 admitted the fact of compromise and stated that he has received the money which was invested by him. 5. Learned counsel for the State submits that it was the petitioner on whose instruction, the complainant deposited the money in the account of co-accused persons. He submits that the fact about the compromise has already been informed to the Investigating Officer, but the said compromise is not been taken into consideration for submission of the final report. The investigation is still pending and the petitioner has been called upon by the Investigating Officer to cooperate with the investigation. 6. We have heard learned counsel for the parties, perused the pleadings and documents. 7. For the sake on convenience, the contents of compromise arrived at between the parties, are reproduced herein-below: इकरारनामा 1. यह किक, प्ቌ कमांक 01 ्ቛारा कि(cid:14)नांक 12.09.2023 को थाना कि(cid:17)धानसभा में एफ.आई.आर. कमांक-324/2023 (cid:14)्ቌ(cid:27) कराया गया था। 2. यह किक, प्ቌ कमांक 01 ए(cid:17)ं सम्यक ्ቌैन के बीच व्य(cid:17)सायियक संबंध है। 3. यह किक, व्यापार में प्ቌ कमांक 01 को ्ቌयि& होने से प्ቌ कमांक 01 4 ्ቛारा सम्यक ्ቌैन के कि(cid:17)रूध्(cid:14) कि(cid:17)धानसभा थाना में धोखाधड़ी का अपराध कमांक 324/ 324 / 2023 पं्ቌीबध्(cid:14) कराया गया है। 4. यह किक, सम्यक ्ቌैन के ्ቛारा व्य(cid:17)साय के (cid:14)ौरान प्ቌ कमांक 01 ने 77,53,000/-रू. ( अ्ቌरी सस्ቈर लाख यि&रपन ह्ቌार रूपये) की राशि1 सम्यक ्ቌैन के ्ቛारा ब&ाये गये कि(cid:17)शिभ्ቐ एकाउंट में ट्रांसफर किकया था। यह किक, उ्ሹ 77,53,000/- रू. ( अ्ቌरी सस्ቈर लाख यि&रपन ह्ቌार रूपये) की राशि1 के हाकिन के ए(cid:17)्ቌ में प्ቌ कमांक 01 को संपू्ቓ(cid:27) राशि1 ्ቚा्቎ हो चुकी है ए(cid:17)ं आपसी समझौ&ा हो चुका है। 5. यह किक, उ्ሹ अपराध कमांक 324/2023 में कि(cid:17)धानसभा थाने के उ्ሹ अपराध में काय(cid:27)(cid:17)ाही के (cid:14)ौरान अशिभयु्ሹग्ቓ सुरे1 गु्ቌ(cid:27)र सां(cid:17)रलाल, ओम्ቚका1 सेन, पटेल बृ्ቌे1, अशिभषेक ्ቌैन को किगरफ्&ार किकया गया है। यह किक उ्ሹ अशिभयु्ሹग्ቓों की ्ቌमान& यायिचका उ्ሴ न्यायालय में लंकिब& है। अ&ः अशिभयु्ሹग्ቓों को उ्ሴ न्यायालय ्ቛारा ्ቌमान& का लाभ कि(cid:14)या ्ቌा&ा है &ो प्ቌ कमांक 01 को उस पर कोई आपቈኌ्ቈ नहीं है। 6. यह किक, अपराध कमांक 324/2023 मुक(cid:14)में में लेन- (cid:14)ेन से संबंयिध& किकसी भी ्ቚकार का मुक(cid:14)मा, सिसकि(cid:17)ल अथ(cid:17)ा किककिमनल सम्यक ्ቌैन ए(cid:17)ं ओम्ቚका1 सेन, सां(cid:17)र लाल, अशिभषेक ्ቌैन, सुरे1 गु्ቌ(cid:27)र, पटेल बृ्ቌे1, महा(cid:17)ीर गोस्(cid:17)ामी, गंगाराम माली, मोहसिसन खान, ्ቌयं&ीलाल सुरा्ቓा, ्ቚेमरा्ቌ गु्ቌ(cid:27)र, बन(cid:17)ारी साहू इन सभी के ቈኌखलाफ पू(cid:17)(cid:27) में कि(cid:14)ये गये नोकिटस ए(cid:17)ं आ्ቌ &क इस सं(cid:14)भ(cid:27) में सि्ቌसको भी नोकिटस कि(cid:14)या गया है। सभी के ቈኌखलाफ किकसी भी &रह की काय(cid:27)(cid:17)ाही नहीं चाह&ा हू ं और उ्ሹ के स समा्቎ करने में पुरा सहयोग करूं गा। 8. investigation, the present petition is disposed of with a direction to the petitioner to appear before the Investigating Officer within a period of two weeks, who shall consider the compromise entered between the parties and submit a police report under Section 173 (2) of Cr.P.C. (193(4) of BNSS 2023), accordingly before the competent Court in accordance with law within a period of two weeks thereafter. The concerned Superintendent of Police shall ensure the compliance of the order of this Court. A copy of original compromise deed be returned to the learned counsel for the petitioner by retaining photo copy of the same 9. Accordingly, the petition is disposed of.
