The petitioner has filed the present writ petition claiming the following reliefs: “10.1 That, this Hon'ble Court may kindly be pleased to quash the order of rationalization of the Government Primary School, Singhangarh, Block Sahaspur Lohara, District Kabirdham (C.G.). 2 10.2 That, this Hon'ble Court may kindly be pleased todirect the respondents to protect the rights of the petitioner as Headmaster of the Government Primary School, Singhangarh after the rationalization process. 10.3 Any other relief which this Hon'ble Court may deem fit in the facts and circumstances of the case.” 2. Learned counsel for the petitioner would submit that the petitioner is presently posted at Govt. Primay School, Singhangarh as Headmaster and the said Primary School has been merged with the Govt. Higher Secondary School, Singhangarh under the rationalization instructions dated 02.08.2024. He would submits that by the merger, the rights of the petitioner is affected as he would be declared surplus and may be posted at some other place. The petitioner is joined in the school on 19.08.2008 and till date he is working as Headmaster of the school with respect to his grievance he has already made his representation to the Respondent No. 5 on 18.07.2025, but till date the same has not been decided by the authorities concerned, therefore, the rights of the petitioner may be protected. 3. On the other hand, learned counsel for the State opposes and have submitted that the petitioner has challenged the merger of the school and it is a policy of the State Government under the rationalization instructions that two schools may be merged under the certain conditions which has been mentioned in Clause 1(A) of the rationalization instructions dated 02.08.2024 and under the strict compliance of the rationalization instructions dated 02.08.2024, the Govt. Primary School, Singhangarh is merged with Govt. Higher Secondary School. The petitioner is apprehending that he would be declared surplus and may be posted to another place which is 3 consequence of merger of the school under the rationalization instructions but till date it has not been reflected from the documents annexed with the petition that no order of posting of the petitioner has been issued, therefore, the petitioner has no ground and the same liable to be dismissed. 4. I have heard learned counsel for the parties and perused the documents annexed with the petition. 5. From perusal of the documents annexed with the petition as well as pleadings made in the petition, it transpires that the petitioner is challenging the merger of Govt. Primary School, Singhangarh to Govt. Higher Secondary School, Singhangarh vide order dated 27.05.2025 (Annexure P/3). In Clause 2 of the said rationalization instructions provided for procedure under which the schools are rationalized and Clause 5 of the said instructions provided for rationalization of the teachers of the school after its merger and declaration of surplus teachers and their management. The rationalization of the schools is the State policy in view of the posting of teachers as teachers less/single teachers/excess teachers school which has been made in the public interest as well as administrative exigency. The teachers who are posted in the school are necessarily to follow the consequences of merger they are declared surplus in the school. 7. In the present case although the Govt. Primary School, Singhangarh where the petitioner is posted, it has been merged with Govt. Higher Secondary School, Singhangarh but till date no order of posting has been issued to the petitioner. The merger of two schools are under the rationalization instructions dated 02.08.2024 which cannot be interfered in the present writ petition. 5 8.
