He further submits that in the State of Chhattisgarh, there are a total of 1,333 Primary Agricultural Societies, and in each of these societies, there are 11 elected members who are agriculturists of the concerned area. These elected members form the Board of Directors. 4) Mr. Sharma also submits that as per the provisions of Section 49(7-A)(i) of the Act, 1960, the term of the President and elected members is for a period of five years. 5) Mr. Sharma further contends that the Department of Cooperative, on 25.07.2019, issued a notification known as the "Chhattisgarh Primary 22 Agricultural Societies Reorganization Scheme, 2019" applicable to the entire State. Clause 8 of the said Scheme was challenged in WPC No. 3031 of 2019 and connected matters. Those writ petitions were allowed, and Clause 8 was struck down, and it was observed that elected members, including Presidents, may be permitted to complete their tenure. He also contends that a fresh notification was issued by the Cooperative Department on 07.03.2020 for the reorganization of societies prescribing the procedure of reorganization in the Scheme of 2019. 6) Mr. Sharma further argues that though certain guidelines were framed under the 2019 Scheme, as per above notification but the same were not adhered to by the respondent authorities while taking steps for the reorganization of societies. A final decision regarding reorganization was taken vide impugned notifications of various dates without inviting objections from the existing Board of Directors of the Primary Cooperative Societies. He also argues that the elected members were not given an opportunity to raise objections in accordance with the 2019 Scheme, and hence, the impugned notifications are bad in law. He prays that a direction be issued to the Registrar, Cooperative Societies, Raipur, Chhattisgarh to consider the objections of the petitioners strictly in light of the 2019 Scheme within a stipulated period. 7) On the other hand, Mr. Gupta, learned Additional Advocate General appearing for the State opposes the submissions made by Mr. Sharma. 23 He submits that writ petitions filed by the Board of Directors of Cooperative Societies challenging the constitutional validity of the notification dated 16.10.2020 have already been dismissed. He states that the constitutional validity of the newly inserted Section 16(C) was also challenged in various petitions and those petitions were dismissed. He would also submit that pursuant to the amendment of Section 16(C) of the Act, 1960, the 2019 Scheme and notifications were issued for all districts across Chhattisgarh. He submits that the decision for reorganization and subsequent elections was taken in the public interest. New Primary Cooperative Societies have already come into existence and their names have been notified. He further submits that due to interim orders passed in the present writ petitions dated 30.11.2021, elections could not be conducted. He submits that sufficient opportunity was provided to the elected members to submit their objections as per the 2019 Scheme, and those objections were duly considered by the competent authority. Therefore, these writ petitions deserve to be dismissed. 8) I have heard the learned counsel for the parties and perused the documents available on the record. 9) The State Government, with an intent to reorganize the Primary Cooperative Societies, inserted Section 16(C) into the Chhattisgarh Cooperative Societies Act, 1960. The vires of the said provision were 24 challenged and the Hon’ble Division Bench dismissed those writ petitions. In light of the new provision, the respondent authorities framed the 2019 Scheme and issued notifications for the reorganization of cooperative societies. The names of the newly constituted Primary Cooperative Societies were notified accordingly. Though elections were scheduled, but could not be conducted due to the interim orders passed in these writ petitions. 10) The main contention of the petitioners is that they were not provided with the opportunity to submit objections in accordance with the guidelines mentioned in the 2019 Scheme, and the prescribed guidelines therein were not followed. 11) The petitioners have prayed that they may be allowed to submit representations before the Registrar, Cooperative Societies, and the said authority may be directed to decide the same expeditiously in accordance with the 2019 Scheme and Section 16(C) of the Act, 1960. 12) The prayer made by Mr. Sharma appears to be fair and reasonable. 13) On account of the interim orders passed in these petitions, the elections of the Primary Cooperative Societies and Cooperative Societies are on hold since 2020. 14) The 2019 Scheme was framed pursuant to the amended Section 16(c) of the Act, 1960, which laid down certain directions/guidelines. Since the petitioners could not file objections/representations before the 25 authorities, therefore, these writ petitions are disposed of reserving liberty in favor of the petitioners to move representations/objections before the Registrar, Cooperative Societies, in light of the 2019 Scheme and amended Section 16(C) of the Act, 1960 within 15 days from today. The Registrar, Cooperative Societies is directed to decide such representations/objections, preferably within a period of 45 days. 15) Interim orders passed in these petitions are hereby vacated. 16) The Registrar, Cooperative Societies, and other concerned authorities would be at liberty to conduct the elections of cooperative societies pursuant to various notifications issued in the year 2020, after the disposal of objections/representations.
