The petitioners have filed this petition seeking the following relief:- 10.1. The Hon'ble Court may pleased be kind enough in calling the records pertaining to the cases related with the orders impugned (Annexure P-1 & P-2). 10.2. The Hon'ble Court may pleased be kind enough in quashing and setting aside the orders impugned (Annexure P-1 & P-2). 10.3. The Hon'ble Court may pleased be kind enough in directing the respondent revenue authorities to correct the revenue records by putting back the names of the petitioners on the respective piece of land as existed earlier before their names were deleted by the revenue authorities on the basis of the orders impugned (Annexure P-1 & P-2). 10.4 Cost of petition, damages & any other relief, which may be deemed fit, by this Hon'ble Court may also be granted to the petitioner.” 2. Mr. Rajkamal Singh, learned counsel for the petitioners would submit as under:- 10 a. He would submit that the property in question, Survey No.54/32 admeasuring 2 acres situated at Lingiyadih, District Bilaspur, was originally recorded in the name of Thanwar. He sold the entire property to Suraj Prasad Pathak on 24.12.1968 through a registered sale deed. b. He would submit that by subsequent sale deed, Thanwar sold the subject property to Shivshankar Prasad Verma through registered sale deed dated 15.11.1969. c. He would also submit that Suraj Prasad Pathak sold the subject property to Tulsidas through a registered sale deed dated 08.04.1974 and in turn, Tulsidas, sold the property to one Balbhadra. d. He would contend that Balbhadra sold the property in parts to 32 petitioners through registered sale deeds executed between 2006 to 2008. e. Mr. Singh would further submit that there was dispute with regard to title of the property, therefore, Surajprasad Pathak filed a Civil Suit No. No.171-A/1971 for declaration of title and permanent injunction. He would contend that the civil Suit was decreed vide judgment & decree dated 05.12.1972, and the said judgment was affirmed in the first appeal and in the Second Appeal, respectively. f. He would submit that there was revenue dispute between Tulsidas and legal representatives of Shiv Shankar Verma. g. He would contend that the suit property was mutated in the names of the petitioners in between 2011 – 2012. h. He would further submit that legal representatives of Shiv Shankar Verma approached the Board of Revenue and the 11 revision preferred by them was allowed vide order dated 30.04.2009. i. He would submit that a review petition was preferred by Tulsidas before the Board of Revenue and it was dismissed vide order dated 18.11.2010. j. He also contends that the petitioners were necessary party to that litigation, but they were not impleaded, therefore, an application was moved alongwith this petition, seeking therein prayer to prefer this petition. k. He would contend that the first sale deed was executed by Thanwar in favour of Suraj Prasad Pathak, who alienated the property to Tulsidas and subsequently, subject property was purchased by the petitioners through registered sale deeds, therefore, the petitioners were necessary party. l. He would submit that the petitioners are in possession of the property and by virtue of sell deeds but pursuant to order passed by Board of Revenue, names of the petitioners have been deleted from the revenue records. m. He would further submit that though the Board of Revenue referred the judgment passed in passed by the Civil Court in the Civil Suit No. 171-A/1971, but failed to consider the claims of the petitioners. He would pray to allow this petition. 3. On the other hand, learned counsel appearing for the respondents opposed the contention made by Mr. Singh. They submitted that the petitioners ought to have approached the Revenue Board by filing a review petition rather than invoking writ jurisdiction directly. It is further contended that there is no dispute with regard to the title of the property, which has already been adjudicated by the learned civil court. The respondents would submit that there is dispute with regard to 12 mutation, and the proper remedy would be review petition before the Board of Revenue, which passed the orders impugned; thus, the petition deserves to be dismissed. 4. I have heard learned counsel for the parties at length and perused the documents carefully. 5. The petitioners purchased the property from Balbhadra, who purchased the property from Tulsidas. The subsequent sale deed was executed by Thanwar in favour of Shivshankar verma on 15.11.1969. There was civil dispute between Suraj Prasad Pathak and Shiv Shankar Verma and the civil suit filed by Suraj Prasad Pathak i.e. Civil Suit No.171-A/1971) was decreed vide judgment and decree dated 05.12.1972, and same was affirmed in the first appeal by the District Court as well as in the Second Appeal by the High Court. 6. It appears that there is no dispute with regard to title of property and the better title was passed in favour of the petitioners by Suraj Prasad Pathak. It appears that there is dispute with regard to the mutation of the property. As Suraj Prasad Pathak filed a Civil Suit and the judgment passed in Civil Suit was affirmed in the first appeal and second appeal, therefore, there was no reason or occasion of the legal representatives of the Shiv Shankar Verma to claim right over the property. The Board of Revenue though considered the judgment passed in that Civil Suit, but failed to provide opportunity of hearing to the petitioners. Tulsidas, who sold the property to Balbhadra has also no right over the property. There may be some dispute between the legal representatives of Shiv Shankar Verma and the petitioners, and therefore, the petitioners ought to have approached the Board of Revenue by filing review petition. 7. As stated by Mr. Rajkamal Singh, the petitioners are in possession of the property in question, therefore, their possession shall not be 13 disturbed and petitioners are permitted to prefer review petition(s) before the Board of Revenue within a period of 30 days. 8. If review petition (s) is/are preferred, it is expected that the Board of Revenue shall decide it after affording due opportunity of hearing to all the interested parties expeditiously strictly in accordance with law. 9. With the aforesaid observation(s) and direction(s), this writ petition is hereby disposed of. 10.Certified copy, if any, be returned after retaining its xerox copy. 11. No order as to costs.
