The petitioner has filed this petition seeking the following relief(s):- “10.1 This Hon'ble Court may kindly be pleased to modify/quash the seniority list dated: 30.08.2021 -2- (P/1), issued by Superintendent of Police, Mungeli, District- Mungeli (C.G.), to an extent that in Serial No.27 of the said list in the eligibility column petitioner may be held as 'eligible' instead of 'ineligible'. 10.2 This Hon'ble Court may kindly be pleased to consider the case of the petitioner at par with the private respondent and hold the petitioner eligible to participate in the selection process against the advertisement dated (sic) 03.09.2021. 10.3 This Hon'ble Court may kindly be pleased to direct the respondent authorities to allow the petitioner to appear in the selection process commencing 15.09.2021 and all consequential/ subsequent benefits in accordance with the law. to grant 10.4 This Hon'ble Court may kindly be pleased to quash the appellate order dated: 01.01.2020 (P/2), issued by the Inspector General of Police, Bilaspur Range, District- Bilaspur (C.G), in light of the judgment cited in case bearing No. WP No. 4016 of 2004, ANIL TIWARI Vs. STATE OF CHHATTISGARH & Ors. decided on 20.02.2007 and to grant all consequential benefits to the petitioner as if the punishment order dated 23.09.2019 was never in existence. 10.5 This Hon'ble Court may kindly be pleased to quash the order dated: 23.09.2019 (P/3), issued by Superintendent of Police, Mungeli, District Mungeli (C.G.), and to grant all consequential benefits from back date to the petitioner as if the punishment order dated 23.09.2019 was never in existence. 10.6 This Hon'ble Court may kindly be pleased to grant any other writ/ writs, order/ orders, relief/ reliefs in favour of the petitioner, which the Hon'ble Court deemed fit & just in the facts and circumstances of the case, including awarding of the costs to the petitioner.”
Legal Reasoning
2. Mr. Sharma, the learned counsel appearing for the petitioner, would submit that the petitioner is holding the post of Constable as he was appointed vide order dated 04.09.2006. He would further submit that an article of charge was issued against the petitioner and respondent 3 No.5 with the allegation that a prisoner escaped from their custody as they were taking him on their bike, whereas a warrant was issued to take the prisoner through public transport. He would contend that the Inquiry Officer and Presenting Officer were appointed, and a departmental inquiry was conducted. The Inquiry Officer submitted its inquiry report, and thereafter, the Superintendent of Police, exercising the power of the disciplinary authority, inflicted the punishment of a penalty of stoppage of one increment with cumulative effect vide order dated 23.09.2019. He would further contend that an appeal was preferred by the petitioner and it was dismissed vide order dated 01.01.2020. Mr. Sharma would also contend that on account of the punishment inflicted by the respondent authorities, the petitioner's name could not be considered for promotion to the post of Head Constable. He would state that the Superintendent of Police was not competent to inflict a major penalty of stoppage of one increment with cumulative effect as prescribed in Regulation 217 of the Police Regulation. He would pray to quash the orders passed by the Disciplinary Authority as well as the Appellate Authority. In support of his contentions, he placed reliance on the judgment passed by the Coordinate Bench in the matter of Anil Tiwari Vs. State of Chhattisgarh and Others, 2007 (2) CGLJ 368. 3. Mr. Goverdhan, learned counsel appearing for respondent No.5 would support the contention made by Mr. Sharma. 4. On the other hand, Mr. Gupta, the learned Additional Advocate General appearing for the State, would oppose the submissions made by Mr. Sharma. He would submit that, according to the provisions of -4- Regulation 221 of the Chhattisgarh Police Regulations (for short ‘the Police Regulations’), the Superintendent of Police may impose a penalty on its subordinates mentioned in Regulations 214 to 217. He would further submit that, according to Regulation 214, the Superintendent of Police may inflict the following penalties on his subordinates which is reproduced herein below : “(i) Censure. (ii) Withholding of promotion. (iii) Withholding of increments of pay including stoppage at an efficiency bar or stagnation allowance. (iv) Reduction to a lower post or time scale or reduction to a lower stage in the time scale of pay for a specified period with further direction as to whether or not the member of the Subordinate Police Service will earn increments of pay or the stagnation allowance, as the case may be, during the period of such reduction and whether on the expiry of such period the reduction will or will not have the effect of postponing the further increments of his pay or stagnation allowance. Note- The expression "reduction to a lower stage in the time scale of pay" shall also include reduction of pay from the stage of pay drawn by a member of the Subordinate Police Service on account of grant of stagnation allowance if any. (v) Recovery from pay of the whole or part of any pecuniary loss caused to Government or to any fund maintained for the welfare of the Police by negligence or breach of orders. (vi). Removal from the service which does not disqualify from future employment. (vii.) Dismiss from the service which ordinarily disqualifies for future employment. (viii) Compulsory retirement.” He would contend that the stoppage of one increment with cumulative effect would come within the purview of Regulation 214(ii) & (iii) of the Police Regulations. It is also contended that when the Superintendent of Police may inflict the penalty of removal from services against Constables and Head Constables, he may also inflict the penalty of stoppage of one increment with cumulative effect. With regard to the judgment cited by Mr. Sharma, he would submit that in 5 the case of Anil Tiwari (supra), the petitioner was a Sub-Inspector and therefore, it was held that the Superintendent of Police cannot impose such a penalty on a Sub-Inspector. He would also contend that sufficient opportunity of hearing was afforded to the petitioner, and after a full-fledged inquiry, the penalty was imposed, and thus, the petition deserves to be dismissed. 5. I have heard learned counsel appearing for the parties and perused the documents placed on the record. 6. In the matter of Anil Tiwari (supra), the petitioner was a Sub- Inspector, who was inflicted with the penalty of stoppage of one increment with cumulative effect and the Coordinate Bench, while dealing with the issue in paras 2 & 8, held as under:- “2.The indisputable facts in nutshell are that the petitioner was working as Sub Inspector in General Category in the Police Department. During his service, the petitioner was awarded a major punishment of withholding of one increment with cumulative effect on finding him guilty of misconduct. The petitioner was suspended vide order dated 29.6.2000 (P/7) contemplating enquiry against him. 8. Mr. V.V.S. Murthy, learned Deputy Advocate General with Ms. Sunita Jain, learned Panel lawyer appearing for the respondents/State would submit that admittedly withholding of one increment with cumulative effect is a major penalty as is clear from the Regulations 214 of the M.P. Police Regulations. The Superintendent of Police can impose the punishment as specified in Regulation 214 (i and iv) and Regulation 215 (a and b), in case of the Sub-Inspector and Assistant Sub- Inspector. Learned counsel fairly concedes that the order passed by the Superintendent of Police, Raigarh suffers from jurisdictional error and is incompetent. Learned counsel would further submit that the jurisdictional error in passing the impugned order of imposition of punishment of withholding of one increment with cumulative effect by an incompetent officer has been cured later on by dismissal of the appeal. Thus, the order is valid and legal.” -6- 7. In the present case, admittedly, the petitioner is holding the post of a Constable. A departmental inquiry was initiated, and thereafter, a penalty of stoppage of one increment with cumulative effect was inflicted by the Superintendent of Police vide order dated 23.09.2019. The said order was challenged by the petitioner by filing a departmental appeal, and it was dismissed vide order dated 01.01.2020. 8. The petitioner has argued that the Superintendent of Police was not competent to inflict the penalty of stoppage of one increment with cumulative effect according to Regulation 217. 9. A bare reading of these provisions would make it clear that the Superintendent of Police may inflict the penalty of stoppage of increments, removal, compulsory retirement and demotion, etc. against his subordinates. 11. Further, a perusal of Regulations 216 & 217 would make it clear that, along with the penalties mentioned in Regulation 214, the Superintendent of Police may inflict these penalties on the Head Constables and Constables. Regulations 216 & 217 of the Police Regulations cannot be read separately. Further, the circulars issued by the Police Department will not prevail over Police Regulations. 12. In the matter of Anil Tiwari (supra), the petitioner was a Sub-Inspector in the police department and the penalty of stoppage of one increment with cumulative effect was passed by the Superintendent of Police, therefore, it was held that such a penalty cannot be inflicted by the Superintendent of Police as the Superintendent of Police can exercise such the power against Constables and Head Constables only. 13. Taking into consideration the above-stated facts, I do not find any good ground to interfere with the order passed by the respondent authorities. Accordingly, this petition fails and is hereby dismissed. 14. However, the petitioner would be at liberty to make a representation claiming therein promotion as a penalty was inflicted in the year 2017, -10- and the period of five years has already elapsed.
