By way of this petition, the petitioner seeks the following reliefs : i.That, this Hon'ble Court may kindly be pleased to issue an writ directing respondent authorities for grant of Compensations / award and rehabilitation to the petitioner according to the right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act 2013 within the stipulated time as this Hon'ble Court thinks fit. ii. Cost of the petition may also be granted to the petitioner. iii. Any other relief, which this Hon'ble Court deems fit and proper, may also kindly be granted to the petitioner, in the interest of justice.

Learned counsel for the petitioner submits that without any acquisition proceedings, the land of the petitioner has been taken over and a road has been constructed over the same.

Learned counsel for the State fairly submits that a demarcation has been conducted, upon which, it was found that a portion of the land of the petitioner has been utilized for construction of the road. He further submits that since the petitioner has already filed 3 a representation before the concerned authorities on 11.8.2025, the respondents will decide the same and pass an appropriate order for grant of compensation.

Considering the facts and circumstances of the case as also considering the arguments advanced by learned counsel for the parties, this Court deems it appropriate to direct the respondent authorities to consider and decide the representation dated

11.8.2025 filed by the petitioner and pass appropriate orders. Further, if, according to the State, a portion of the land has been taken over, they are required to calculate and grant compensation in respect of the land of the petitioner, which has been utilized without any acquisition proceedings. This entire exercise shall be completed by the State within a period of 60 days from the date of receipt of a certified copy of this order. Ordered accordingly.
