Legal Reasoning

The brief facts, as reflected from the record are that: a) The petitioner is the District Superintendent of the Methodist Church in India (in short “the Church”) which is a Public Trust registered in the year 1954. The Church was granted lease of land by the erstwhile Bastar Ruler on 23.03.1923 for area of 16.29 acres situated in the village Arserpur, erstwhile Bastar State Central Province now District - Jagdalpur Bastar (C.G.). The lease was granted to the mission authorities utilizing the site for purpose of said mission and without the permission in writing of the lessor the said land cannot be used for any other purpose. The Condition 4 further provides that the lessee shall not assign, underlet or otherwise part with the permission of any right in the aforesaid premises or any part thereof without the permission in writing of the lessor. b) The lease was expired thereafter, the lease was renewed by the Collector as per the power conferred to him under the Revenue Book Circular. A dispute arose between the Church and the State Government over renewal of lease which led into a series of litigation including filing of the W.P. No. 3693/1994. This Court vide order dated 17.11.2009 has passed the order directing the respondent No. 1 and 2 State to renew the lease deed in favour of the petitioner Church Jagdalpur within a period of 8 weeks from the date of receipt of the production of copy of this order. Accordingly, the Executive Secretary of the Church made an application on 09.12.2009 for renewal of lease deed. c) After the order of this Court, the proceedings for renewal of lease 3 were initiated by way of Revenue Case No. 40/A-4/2009-10 and during pendency of the proceedings, in the year 2017 a registered society namely Bastar Methodist Episcopal Mission Society, Jagdalpur, District Bastar under the provisions of the CG Societies Registrikaran Adhiniyam, 1973 who is respondent No. 4 through its President raised an objection, but proceedings for renewal of lease was continued by the Nazul Officer on 13.02.2018 wherein a fresh report was called as in the earlier report dated 27.03.2010 there were some discrepancies. The fresh report was submitted on 16.03.2018, however, during pendency of the lease renewal case, the State Government allotted some portion of the Church's land to other persons. The Collector called for No Objection Certificate from the Church which was given by the Church and vide order dated 05.04.2018 the Church was finally called to deposit the Premium and the Church deposited the premium on 16.04.2018 through challan. Thereafter, lease was granted on 13.09.2019 in favour of Superintendent Methodist Episcopal Mission, District Bastar/respondent No. 5 (Annexure P/18). . 3. Thereafter, the present petitioner moved an application on 20.08.2019 (Annexure P/12) for review of the order granting a lease in favour of the respondent No. 5 and to renewal of lease in his name mainly contending that the petitioner is now working as Superintendent of Methodist Episcopal Mission, District Bastar and all the work of the Church in the name of Superintendent. He has also submitted an affidavit claiming himself to be Superintendent of Methodist Episcopal Mission Church. Thereafter, the Collector by the impugned order (Annexure P/1) dated 24.03.2022 has rejected the said Review 4 Application by recording its finding that the lease has already been executed on 13.09.2019 and the Collector has no jurisdiction to cancel the lease granted in favour of respondent No. 5. 4. Being aggrieved with this order the petitioner has filed the present writ petition mainly contending that the impugned order dated 24.03.2022 (Annexure P/1) is illegal, without consideration of material facts, without issuing a notice to the petitioner and the lease has been granted ignoring the stay passed by this Court on 28.07.2018 and has prayed for quashing of the order dated 24.03.2022 (Annexure P/1) and the order dated 13.09.2019 (Annexure P/18) granting lease in favour of the respondent No. 5. 5.

Legal Reasoning

Learned counsel for the petitioner has placed on record the copy of the constitution of the Church and would submit that they are the authorized persons to execute the sale deed. He has also placed on record the Certificate of Registration of the Trust by way of Exhibit D/2. It has also been submitted that they are following the terms and conditions of the lease, as such the petitioner is the authorized person to execute the lease deed. It has also been denied that they have sold some of the property of the Church and the respondents No. 4 and 5 themselves violated the order passed by this Court with regard to maintaining the order of status quo passed by this Court by construction work and to substantiate the submission he has placed on

record the photographs and would pray for allowing the writ petition. 6. Learned senior counsel for the respondents No. 4 and 5 has placed on record the copy of the sale deed executed by the petitioner and contended that they are violating the condition of the lease by selling the said properties, as such the order has been rightly passed and it 5 has also been contended that the respondents No. 4 and 5 are the competent to execute the lease, as such, the Collector has rightly executed the lease in favour of the respondents No. 4 and 5 and would pray for dismissal of the writ petition. 7. 8. I have heard learned counsel for the parties and perused the record. From the submissions and documents annexed with the writ petition, the point emerged for determination is: “Whether the District Collector was justified to reject the prayer for review of the order by way of cancellation of lease granted in favour of respondent No. 4 and 5?” To determine the issue, it is expedient for this Court to go through the power and authority exercised by the Collector while granting lease. The State Government has issued Revenue circulars in the name of Chhattisgarh Revenue Book Circulars. These circulars have been issued to carryout various provisions of Land Revenue Code 1959. Accordingly, the State Government in his Revenue Book Circular Part - 4 Serial No. 1 has issued the circular regarding management and law of Nazul land situated in Municipal Corporation, Municipal councils and within the notified areas. As per the definition of Nazul, the Government Land which is used for construction or public amenities like market place of entertainment or it has to be used in future for these purposes. Section 2(d) defines “Abadi”, it means the areas which are being reserved for the residence of that area for residential purpose, but the said land will be included in the Nazul Land and persons who are legally authorized to possess the said land they will be called as Bhumi Swami and the lands which are open, it will be used as Nazul land. 6 Accordingly, the Government has issued various provisions for taxation of Nazul land as well as granting of lease and also provides categories of the authorities as per Clause 17 of Revenue Book Circular Part-4 No. 1 who are competent to execute the lease deed. According to the Schedule at Serial No. 4 as amended for the State of Chhattisgarh, for allotment of lease of Nazul lands for 30 years or less than 30 years or its renewal, the power lies with the Collector. 9. Clause 18 provides that the authorities who are competent to decide the representation against the order passed by its subordinate authorities. From perusal of the abovestated provisions of Revenue Book Circular, it is quite vivid that the Collector has power to grant lease, but he has no power to cancel or review its order. It is well settled position of law that unless and until the Quasi Judicial Authorities have power to review its own order, they cannot review its own order and power of review on merits is not an inherent power. Such a power must flow from some specific provision in the enactment under which rights of the parties are determined. I am amply fortified here with several decisions of the Hon’ble Supreme Court on this aspect of the controversy. 11. Few of the judgments are as follows: a) In Patel Chunibhai v. Narayan Rao & Others reported in AIR 1965 SC 1457, the Hon’ble Supreme has held at paragraph 8 as under:- "8 …These orders passed by the Collector in the exercise of his revisional powers were quasi-judicial and were final. The Act does not empower the Collector to review an order passed by him under Section 76-A. In the absence of any power of review, the Collector could not subsequently recon- sider his previous decisions and hold that there were grounds for annulling or reversing the Mahalkar's order. The subse- quent order dated February 17, 1959 reopening the matter was illegal, ultra vires and without jurisdiction...." b) In Patel Narshi Thakarshi v. Praduman Singhji reported in (1971) 3 SCC 844, the Hon’ble Supreme has held at para- 9 graph 4 as under: "4. …It is well settled that the power to review is not an inher- ent power. It must be conferred by law either specifically or by necessary implication. No provision in the Act was brought to our notice from which it would be gathered that the Gov- ernment had power to review its own order. If the Govern- ment had no power to review its own order, it is obvious that its delegate could not have reviewed its order…" c) In Dr. (SMT.) Kuntesh Gupta vs. Management of Hindu Kanya Maha Vidyalaya Sitapur (U.P.) & Others reported in 1987 4 SCC 525, the Hon’ble Supreme Court in paragraph 11 has held as under: “11. It is now well established that a quasi judicial authority cannot review its own order, unless the power of review is ex- pressly conferred on it by the statute under which it derives its jurisdiction. The Vice-Chancellor in considering the question of approval of an order of dismissal of the Principal, acts as a quasi judicial authority. It is not disputed that the provisions of the U.P. State Universities Act, 1973 or of the Statutes of the University do not confer any power of review on the Vice- Chancellor. In the circumstances, it must be held that the Vice-Chancellor acted wholly without jurisdiction in reviewing her order dated January 24, 1987 by her order dated March 7, 1987. The R said order of the Vice-Chancellor dated March 7, 1987 was a nullity” 12. As such, in view of well settled legal position that in absence of a provision for review an authority or even a tribunal for that matter cannot review orders passed in exercise of quasi judicial functions, therefore, I am of the view that the impugned order passed by the learned Collector does not suffer from perversity or illegality which warrants interference by this Court. 13. Also considering the fact that the Revenue Book Circular empowered the aggrieved person to prefer a writ petition as per Clause 18 of the Revenue Book Circular and since in this case the petitioner is aggrieved with the order of Collector, he can prefer a representation before the Commissioner Bastar Division or the State Government as 10 per the provisions made in this behalf, therefore, the writ petition is disposed of granting liberty to the petitioner to make a representation before the Commissioner Bastar Division or the State Government as the case may be, within a period of 45 days from the date of receipt of copy of the order and in turn the competent authority will decide the same in accordance with law giving opportunities to all the parties. It is also directed that this Court has ordered for status quo with regard to the property on 05.07.2022, that interim order is still continuing and will remain in force for 9 months from the first date of the filing of the application by the petitioner before the authorities. In the meanwhile the competent authority will decide the matter within 9 months from the date of filing of the application by the petitioner in accordance with law. 14. It has been reported that the land allotees are selling the properties causing numerous disputes, therefore, to secure the interest of the parties, let the Collector be appointed as Receiver for looking after the affairs of the property and the parties who are in-charge of the properties will submit the books of account and earning from the said property to the receiver every month. The worship performed at the Church shall continue without any hindrance. If anyone creates problem, the Government Machineries are free to take action. It is made clear that neither the petitioner nor the respondents will make any attempt to disturb the existence of property in question by way of sale or mortgage or any other mode of transferring the same. The parties are further directed not to violate any terms and conditions of lease granted by the Ruler of erstwhile Bastar State Central Province which have been continued by the State Government. If any violation of one of the conditions is made the Collector will submit his report to 11 the authority to whom representation has been submitted by the petitioner as per Clause 18 of the Revenue Book Circular. 15.
