Petitioner has filed this writ petition seeking following reliefs: “1. That, the Hon'ble Court may be pleased to issue an appropriate writ(s), order(s) or direction(s) to set aside the suspension of the petitioner in the light of Ajay Kumar Choudhary v. That, the Hon'ble Court may be pleased to grant any other relief, which this Hon'ble Court deems fit in the facts circumstances of the case, in favour of the petitioner including the cost of the petition, in the interest of justice.”
2. Learned counsel for the petitioner submits that petitioner while working on the post of Pharmacist (Aayurved) and posted at Govt. Aayurved Dispensary, Bhathli, District Janjgir-Champa was put under suspension on 10.01.2024 with effect from 22.11.2023 as petitioner was implicated in criminal case and was arrested also. He submits that after lapse of reasonable period of time, petitioner submitted representation before respondent No.2 for revocation of suspension on 04.03.2024 and 24.06.2024 which till date is pending consideration and no decision has been taken.
Learned counsel for the State submits that in view of submission of learned counsel for petitioner, if representation submitted by petitioner is still pending consideration, appropriate order in accordance with law will be passed.
On due consideration of submission of learned counsel for the parties, without entering into merit of case, this writ petition at this stage is disposed of directing respondent No.2 to take decision on pending representation of petitioner as referred to above, in accordance with law, expeditiously, preferably within a period of one month from the date of receipt of copy of this order.
