Heard Mr. Sabyasachi Bhaduri, learned counsel for the petitioner. Also heard Mr. Priyank Rathi, learned Government Advocate, appearing for the State and Mr. Trivikram Nayak, learned counsel appearing for respondent no. 2.

The present petition has been filed by the petitioner under Article 226 of the Constitution of India, seeking following reliefs: “10.1 That, this Hon’ble Court may kindly be pleased to call for record of entire tender process which is subject matter of the present petition.

10.2 That, the Hon’ble Court may kindly be pleased to direct the Respondent Corporation to make good remittance of the payment pending to be made to petitioner amounting to Rs. 17,46,605/- along with interest accruing thereon for the goods and services already supplied by the petitioner and Rs. 15,03,612/- deducted by the Respondent vide payment advise 29.09.2021 and Rs. 17,73,693/- deducted b the Respondent vide their payment advise dated 03.02.2022;

10.3 That, the Hon’ble Court may kindly be pleased to quash the illegal deductions 3 made by the respondents for the goods already supplied by the petitioner.

10.4 That, the Hon’ble Court may kindly be pleased to grant any other relief(s)/order(s)/direction(s) in favour of petitioner, which this Hon’ble Court may deem fit and proper in the facts and circumstances of the case, in the interest of justice.

10.5 Cost of the petition.”
