Aceorduig to leamed coiuisel for the petitioner fhe fourth child of fhe petitioner was boru ou 16.1.2001 for which he has produced a certificate of fhe poUce station Jaijaipur, District- Janjgir Cham.pa, when adinittedly fhe petitioner was a resident ofviBage Semradeeh, PoUce Station Jaijaipur. h..- The Director Panchayat after having considered aB other certi&cates/documents, issued by the Block Developmcnt Ofiicer, Basna and sterilization operation (fnTnily planiung operation) done, thereafter on 5.4.2003 came to the conclusion fhat the foiirfh chUd of tfae petitioner was bora on 8.2.2003 in his residence at village Kohiladevri. The petitioner concealmg fhe said fact was elected as Sarpanch of fhe Grara Paachayat contrary to fhe provisions of Section 36 (l) (m) ofthe Panchayat Raj Avain Gram Swaraj Adhiniyam, 1993. Upon perusal offhe impugaed order as weB as other documents appended thereto, ia. my opiiuon, there is no mfiniuly in the impi^ned order. Thus, this Court in exercise of its powera under Article 226 of the Constitution of India is not mclined to mterfere wifh ftie onier dated 8.1.2007 (Annexure P/10) passed by the Dircctor, Panchayat.
