The petitioner has preferred instant petition under Article 227 of the Constitution of India seeking following relief:- i. Issue appropriate writ or order to quash the order as per Annexure-E dated 15.1.2024 passed by MACT, Balod on IA filed under Order 7 Rule 11 CPC read with Section 166 (3)(Amendment Act 2019) in MVC No.41/23. ii. Allow the application filed by the petitioner as per Annexure C and hold the claim petition as per AnnexureA as not maintainable. 2 iii. Pass such Order writ or order as this Hon’ble Court deems fit under the circumstances of the case in the interest of justice and equality.
It transpires from the cause-list that present petition has been reported to be defected on several counts. It appears that the learned counsel for the petitioner has filed present petition in a casual manner and he even has not taken pains to rectify the defects.
Learned counsel for the petitioner submits that present petition may be disposed of as withdrawn with liberty to file a duly constituted petition.
On due consideration, permission is granted to withdraw the writ petition with liberty as prayed for, subject to payment of cost of Rs.1000/- payable to High Court Legal Services Authority, within a week.
