By way of this petition, the petitioner has prayed for following reliefs:-

(i) The petitioner above named most humbly prays to this Hon'ble Court to call for entire records pertaining to the election of the Adyaksha Nagar Palika Parishad Ratanpur. (ii) The Hon'ble Court may kindly be pleased to suitably direct the respondents to take/ decide the applications filed by the petitioner before the respondents' authorities. (iii) In case of favorable decision for the petitioner, taken by respondents authorities, they may kindly be pleased to directed to declare the fresh result accordingly instead of the Annexure P/1, which is declared on 15/02/25. (iv) Any other relief, which may suitable in the facts and circumstances of the case along with cost of this petition, may also be allowed.

The respondent counsel has stated that result of the election has been declared and the petitioner should have filed the Election Petition under Section 20 of Municipalities Act, 1961 before appropriate forum.

Learned counsel for the petitioner submits that he seeks permission of this Court to withdraw this petition and to file a fresh duly constituted Election Petition under Section 20 of Municipalities Act, 1961 before appropriate forum .

Accordingly, the prayer is allowed and the instant petition is disposed of with liberty to file a fresh duly constituted Election Petition under Section 20 of Municipalities Act, 1961 before appropriate forum. Sd/- (Amitendra Kishore Prasad) Judge Raghu Jat
