This is the first appeal filed by the intended purchaser of the subject property of a house situated at Vinoba Nagar, Shesh Colony, Street No. 10, ward No. 14, Bilaspur having a Khasra No. 776/16, (776/129) Sheet No. 23, Block No. 5, Plot No. 313/32 area 2400 sq. ft. for which an agreement was executed between the appellant Ajay Singh and the respondent No.1 Smt. Sadhna Bakshi on 17.06.2000. The respondent No.2 Smt. Sujata Mitra is the sister of respondent No.1 Smt. Sadhna Bakshi. The respondent No.1 is claiming that she inherited the property of her mother whereas the respondent No. 2 claiming that her mother has executed a will dated 05.07.1999 in her favour and she became the owner of that property. The sale deed of the subject property could not be executed in favour of the intended purchaser/appellant, therefore, he filed a Civil Suit No. 376-A/2012 before the learned Additional Sessions Judge, Bilaspur. After the trial of the civil suit, the same has been dismissed by the learned trial Court vide its judgment and decree dated 14.12.2018. 3. The judgment and decree dated 14.12.2018 has been challenged by the present appellant in the present appeal. During the pendency of the present appeal the respondent No.6 Dr. Krishna Pratap Pandey has entered into compromise with respondent No.2 who was claiming to be the owner of the aforesaid property through the will dated 05.07.1999 executed by her mother. The respondents No. 3 to 5 are the children of respondent No. 2. The compromise between the respondent No.6 Dr. Krishna Pratap Pandey and the respondent No.2 has taken place in the First Appeal No. 348/2018 which was disposed of before the National Lok Adalat 3 dated 14.12.2024 and the sale deed executed in favour of the respondent No.6 by the respondent No.2 Smt. Sujata Mitra is admitted by the respondent No.2 as well as the present respondent No.1 Smt. Sadhna Bakshi. 4. Now in the present appeal the respondent No.6 who is the purchaser of the property has entered into compromise with the present appellant Ajay Singh in the following terms and conditions: " समझौते का मसौदा प्ቌकारगणों की ओर से नि(cid:19)वेद(cid:19) है। यह निक, मौजा निव(cid:19)ोबा(cid:19)गर, खसरा (cid:19)ं. 776/129, में ቝኌ#$त ब्लॉक (cid:19)ं./ वग.नि/ट भूनिम में 34 शेष कालो(cid:19)ी गली (cid:19)ंबर 10, रकबा 2400 शीट (cid:19)ं. 23, 1. भू खण्ड ्ቅ. 313/32 वष. पूव. से उ्ቈरवादी ्ቅ.2) $ी, जिजसके नि(cid:19)ኌमत मका(cid:19) है जिजसकी पूव. भू #वामी ्ቦीमतित सुजाता निम्ቔा ( में हुयी ्ቛारा उ्ሹ संम्पतित को जिसनिवल न्यायालय निबलासपुर के ्ቚकरण ्ቅमांक 176-ए/2015 को पंजीकृ त तिड्ቅी एवं आदेश निद(cid:19)ांक 03.12.2018 को ्ቦीमतित निव्ቅय प्ቔ के माध्यम से सदैव के वा#ते डॉ. साध(cid:19)ा बक्सी की उपቝኌ#$तित एवं सहमतित त$ा निव्ቅय प्ቔ की सा्ቌी के रुप में ह#ता्ቌर कर, उ्ሹ सम्पቈኌ्ቈ को निव्ቅय कर उसका #वानिमत्व सौपा जा चुका है त$ा मा(cid:19)(cid:19)ीय उ्ሴ न्यायालय निबलासपुर में लंनिबत ्ቚ$म अपील ्ቅमांक 348/2018 ( ्ቦीमतित सुजाता निम्ቔा निवरु्ቍ डॉ. कृ ष्ण को कराया ्ቚताप पाण्डेय) जा चुका है। अतः उपरो्ሹ सम्पቈኌ्ቈ पर ्ቦीमतित साध(cid:19)ा बक्सी एवं सुजाता निम्ቔा का अब निकसी भी ्ቚकार का हक/दावा/ आतिधपत्य शेष (cid:19)हीं है एवं उ्ሹ सम्पቈኌ्ቈ सम#त राज#व रिरकाड. में डॉ. कृ ष्ण ्ቚताप पाण्डेय ( के परिरपाल(cid:19) में निद(cid:19)ांक 11.03.2024 उ्ቈरवादी ्ቅ.6) का नि(cid:19)राकरण लोक अदालत के माध्यम से निद(cid:19)ांक 14.12.2024 के (cid:19)ाम से दज. की जा चुकी है। कृ ष्ण ्ቚताप पाण्डेय ( उ्ቈरवादी ्ቅ.6) व 5 (कु . ्ቚस्ቐजीत निम्ቔा) यह निक इस ्ቚकरण के उ्ቈरवादी ्ቅ. 3 ( 2. है। त$ा उ्ቈरवादी ्ቅ. 4 निम्ቔा के ्ቛारा सम्पूण. निव्ቅय ्ቚतित/ल की राशिश, डॉ. का नि(cid:19)#पांद(cid:19) निकया गया है त$ा उ्ቈरवादी ्ቅ. 4 सुजाता निम्ቔा ( व 5 में हो चुकी की माता ्ቦीमतित सुजाता कृ ष्ण ्ቚताप पाण्डेय से ्ቚा् कर निव्ቅय प्ቔ के ्ቛारा निव्ቅय हेतु सहमतित प्ቔ ्ቦीमतित को ्ቚदा(cid:19) निकया गया $ा। अतः उ्ሹ सम्पतित में उ्ቈरवादी ्ቅ. 4 का भी निकसी भी ्ቚकार का हक / की मृत्यु वष. 2024 ईशता निम्ቔा व कु . उ्ቈरवादी ्ቅ.2) दावा शेष (cid:19)हीं है। रुशिशता निम्ቔा) व 5 3. यह निक, 376 ए/2012 निवनि(cid:19)ኌद्ቖ पाल(cid:19) हेतु ्ቚ#तुत निकया गया $ा जो निक निद(cid:19)ांक 14.12.2018 के ्ቛारा खरिरज निकया गया $ा, अपीला$S अजय िሺसह के ्ቛारा भी उ्ሹ सम्पቈኌ्ቈ के संबंध में जिसनिवल वाद ्ቅमांक को संनिवदा के को जिसनिवल न्यायालय जिजस पर अपीला$S के ्ቛारा यह ्ቚ$म अपील ्ቚ#तुत की गई है। अपर जिजला न्यायालय निबलासपुर के सम्ቌ निद(cid:19)ांक 26.06.2012 चू यह निक, उ्ቈरवादी ्ቅ.6) ँनिक उ्ሹ सम्पቈኌ्ቈ पर आज निद(cid:19)ांक को हक एवं #वानिमत्व एकमा्ቔ डॉ. 4. पाण्डेय ( अपीला$S एवं उ्ቈरवादी ्ቅ.6 लोक अदालत के माध्यम से नि(cid:19)म्(cid:19)ቈኌलቈኌखत शतW पर कर(cid:19)े हेतु सहमत हो गये है। कृ ष्ण ्ቚताप नि(cid:19)राकरण हेतु का अतिधकार है त$ा वे दो(cid:19)ों ्ቚकरण का शांतितपूव.क नि(cid:19)राकरण का ही है अतः उ्ሹ सम्पቈኌ्ቈ से संबंतिधत इस निववाद के यह निक, 5. भू खण्ड ्ቅ. 313/32 नि(cid:19)ኌमत मका(cid:19) है, नि(cid:19)म्(cid:19) शतX है :- मौजा निव(cid:19)ोबा(cid:19)गर, शीट (cid:19)ं. 23, शेष कालो(cid:19)ी गली (cid:19)ंबर 10. रकबा 2400 वष. पूव. से जो निक इस अपील में भी निववानिदत सम्पቈኌ्ቈ है उ्ሹ सम्मቈኌ्ቈ हेतु समझौता की में ቝኌ#$त ब्लॉक (cid:19)ं./ वग.नि/ट भूनिम में 34 खसरा (cid:19)ं. 776/129, यह निक, डॉ. उ्ቈरवादी ्ቅ.6), कृ ष्ण ्ቚताप पाण्डेय ( (अ) अपीला$S अजय िሺसह आ० ्ቦी लाल साहब को उ्ሹ सम्पቈኌ्ቈ के संबंध में हुये खच. एवं ्ቌतितपूቈኌ्ቈ के रुप में रुपयें 30,000,00/- ( दे(cid:19)े हेतु सहमत है जिजसके ्ቚतित/ल #वरुप आज निद(cid:19)ांक 10.05.2025 पुरा(cid:19)ा बस #टैण्ड निबलासपुर का चार लाख मा्ቔ) चेक ्ቅमांक 674450 अनि[म रुप से छब्बीस लाख मा्ቔ) ्ቚदा(cid:19) कर रहा है। त$ा शेष राशिश 26,000,00/- ( भारतीय #टेट को भारतीय #टेट बैंक, के ्ቛारा राशिश 4,000,00/-( तीस लाख मा्ቔ) 4 पुरा(cid:19)ा बस #टैण्ड निबलासपुर का चेक ्ቅमांक 674451 बैंक, का चेक ्ቚदा(cid:19) कर रहा है। निद(cid:19)ांक 25.06. 2025 यह निक, अपीला$S निद(cid:19)ांक 25.06.2025 कृ ष्ण ्ቚताप पाण्डेय ( (ब) के पूव. ऊपर वቓኌणत सम्पቈኌ्ቈ का उ्ቈरवादी ्ቅ.6) पूण.ता रिर्ሹ आतिधपत्य डॉ. को ्ቚदा(cid:19) करेगा तत्प्ቐात ही चेक में वቓኌणत 26,000,00/- ( छब्बीस लाख मा्ቔ) ्ቚा् करेगे त$ा भनिवष्य में उ्ሹ सम्पቈኌ्ቈ के संबंध में निकसी भी ्ቚकार का निववाद/दावा, डॉ. कृ ष्ण ्ቚताप पाण्डेय के निवरु्ቍ (cid:19)हीं करेगा। यह निक, यनिद उ्ቈरवादी ्ቅ. 6 (स) अपीला$S को राशिश ्ቚा् (cid:19)हीं होती है तो, कर(cid:19)े हेतु वैधानि(cid:19)क काय.वाही कर(cid:19)े हेतु #वतं्ቔ रहेगा। के ्ቛारा निदये गये उ्ሹ चेक के माध्यम से वह ्ሹ सम्पቈኌ्ቈ का पु(cid:19)ः आतिधपत्य ्ቚा् उपरो्ሹ सहमतित दो(cid:19)ो प्ቌकारों के मध्य निववाद का शांतितपूव.क नि(cid:19)राकरण हेतु निब(cid:19)ा निकसी भय या दवाव के ब(cid:19) गई है। अतः इ(cid:19) शतW के आधार पर मा(cid:19)(cid:19)ीय लोक अदालत से तिड्ቅी पा(cid:19)े हेतु दो(cid:19)ों प्ቌकार सहमत है। 6. अत: मा(cid:19)(cid:19)ीय न्यायालय से सादर नि(cid:19)वेद(cid:19) है निक अपीला$S एवं उ्ቈरवादी ्ቅ.6 के मध्य हुये इस सहमतित शतW के आधार पर इस ्ቚ$म अपील का नि(cid:19)कारण लोक अपीला$S के ्ቛारा अदा निकया गया न्याय शुल्क, अदालत के माध्यम से करते हुये, अपीला$S को वानिपस निदलाया जावे।" 5. The terms and conditions of the समझौते का मसौदा has been agreed by the respective parties i.e. Ajay Singh (Appellant) as well as Dr. Krishna Pratap Pandey respondent No.6 and have not raised any objection if the present appeal is disposed of in terms of the compromise settled at between the parties. 6. We have verified terms and conditions settled between the parties the appellant and respondent No.6 who are present today and they have agreed with the terms and conditions mentioned in the aforesaid agreement. 7. The terms and conditions mentioned in the agreement dated 10.05.2025 appears to be genuine and they are permitted to entered into compromise in the matter and in view of the compromise between the parties, the present first appeal
Decision
