Proceedings of these matters have been taken through Video Conferencing. Heard Mr. Raza Ali and Mr. Vikas Dubey, learned counsel appearing for the respective appellants/writ petitioners. Also heard Mr. Sangharsh 16 Pandey, learned Government Advocate, appearing for the State, Mr. Pankaj Agrawal, learned counsel appearing for the State Urban Development Authority (for short, “SUDA”) as well as Ms. Juhi Anguriya, learned counsel appearing for the private respondents. 3. Since all these appeals arise out of a common order passed by the learned Single Judge in WP(S) No. 3135/2018 and other connected matters on 23.01.2024, they are being considered together by this common judgment. WA No. 158/2024 and WA No. 183/2024 arise out of WP(S) No. 2963/2018, WA No. 166/2024 arises out of WP(S) 3448/2018, WA No. 177/2024 and 179/2024 arise out of WP(S) No. 3135/2018 and WA No. 182/2024 arises out of WP(S) No. 3687/2018. 4. WA No. 158/2024 which arises out of WPS No. 2963/2018, is taken as the lead case. 5. The appellants/writ petitioners had filed writ petitions before the learned Single Judge challenging the order dated 26.03.2018 passed by the Chief Executive OfÏcer, State Urban Development Authority (SUDA) and the agreement dated 14.07.2016 executed between the SUDA and the respondent No. 8-Rajhans Consultants and Technocrat Pvt. Ltd.
Decision
According to the writ petitioners, the respondents had undergone an agreement dehors the policy / scheme of the National Urban Livelihood Mission (NULM) a Scheme of the Ministry of Housing and Urban Poverty Alleviation, Government of India which is implemented through State’s machinery. According to the writ petitioners/appellants, the SUDA had issued direction to the City Project OfÏcer and Mission Manager, Deendayal Antyoday Yojna, NULM, Durg and Bhilai to send the details of the writ petitioners to the respondent-Rajhans Consultants and Technocrat Pvt. Ltd., a private agency having no concern under the 17 Scheme otherwise, in order to grant them continuation of service. In furtherance of the same, the writ petitioners were asked by the respondent-City Project OfÏcer not to visit the workplace in case they do not intend to be deployed through the respondent-Rajhans Consultants and Technocrat Pvt. Ltd. 6. Mr. Raza Ali as well as Mr. Vikas Dubey, learned counsel appearing for the respective appellants/writ petitioners submits that appellants/writ petitioners and other persons were appointed as Community Organizer on contractual basis, which is accordance with the scheme and policy of the Government of India and the State was only to implement the same and as per the policy the appointment of the Community Organizer have to be done on contract basis and there is no provisions for the appointment through other placement agencies, except the post of Technical Experts. Further the State, since from 1990 appointed the Community Organizers (for short, the COs) by way of contract basis and continue the services of the appellants, and in the year 2017-18, the State has acted contrary to that and has passed the order/notifications for stopping the appointment on contract basis and entered into an agreement with the private respondent agencies to make appointment through placement agencies. The appellant/writ petitioners then raised the objections and filed writ petitions before the learned Single Judge bearing WPS No. 2963/2018 and other connected petition had also been preferred by the similar persons and sought the quashment of the order and agreement passed and executed by the State. The respondent State did not dispute the facts that as per the policy. the appointment was to be made on contract basis but filed some clarifications which was sought from the Central Government and in that clarifications also, the Central Government has specifically mentioned 18 that the appointment have to be made on contractual basis except for the Technical Post. The learned Single Judge, vide her order dated 23.01.2024, rejected the bunch of writ petitions on the ground that regularization of the post is a policy decision of the State and the Court cannot interfere with the policy decision of the State, whereas the challenge made in the writ petition was on different grounds and was only to the order dated 26.03.2018 and agreement executed by the State for placing the post of the COs from contractual appointment to placement agencies and thus the learned Single Judge while passing the judgment has gone in question which was not the subject matter of the petition. 7. Learned counsel for the appellants/writ petitioners further submit that the appellants were appointed to the post of the CO and the policy earlier in 1990 known as Urban Basic Services for poor (UBSP), later the name of scheme changed to Swarna Jayanti Shahri Rojgar Yojna (SJSRY) and then changed the name to National Urban Livelihood Mission (NULM), the said scheme is funded by the Government of India and implemented by the State authorities and for the functions and appointment the policy has been enacted and in each and in every scheme, the appointment of the COs have been done by way of contractual basis directly between the State and employee and there is no role of any placement agencies, but suddenly without authority and contrary to the policy the respondent State has entered into an agreement with the private agency to conduct the work of the COs and other posts, for which the petitioners and other employee have objected the same and filed the writ petitions before the learned Single Judge but the learned Single Judge, instead of deciding the subject matter placed in the writ petition has gone into the issue of regularization, which was not the subject matter of the petition and 19 therefore the order under challenged is liable to be set aside and in effect the agreement and order of the State authorities by placing the post of CO in placement agency are liable to be quashed. Some of the person in the batch of writ petition, excluding the appellant have not joined the services under the placement agency as those persons are against the said order /agreement which was being contrary to the policy of the service and preferred the writ petition along with the appellant and other person and therefore all the persons including the appellant are entitled for the wages and compensation for the wrong and illegal action of the respondent State. The respondents have acted dehors the policy for the appointment, as the policy which has been annexed along with the writ petition has only authorized the State to make appointment of Technical Expert through outside agency but there is nothing in the policy which enables the State to appoint the COs and other non-technical post from the outside agency and the said act, order and agreement was challenged before the Hon'ble Single judge, but the same has not been considered. So far as the issue for regularization the appellants have already filed the separate petitions. 8. 9. On the other hand, Mr. Thakur, learned Deputy Advocate General for the State/respondent, while supporting the order passed by the learned Single Judge, submits that the main contesting party in these appeal is the respondent-SUDA. Mr. Pankaj Agrawal, learned counsel for the respondent-SUDA submits that extension of the Scheme has not been granted by the Union of India till today and the same was only upto 31st March, 2025. The contract between the SUDA and the placement agencies have already come to an end and as such, these appeals have become infructuous. Earlier the 20 appellants/writ petitioners were employed by the SUDA under the Swarna Jayanti Scheme but after lapse of the new scheme, under the instructions of the Central Government, the appellants were employed through placement agencies by outsourcing. Firstly, the appellants were employed under the respondent-Rajhans Consultants and thereafter under the respondent-Call Me Services. As the Scheme itself has been discontinued, the SUDA cannot continue the services of the appellants/writ petitioners, which even otherwise are not directly employed but are the employees of the placement agencies. 10. We have heard learned counsel for the parties, perused the pleadings and documents appended thereto. 11. These appeals were taken upon for hearing on 13.06.2024, and an interim relief was granted in favour of the appellants/writ petitioners, which reads as under: “Heard Mr. Raza Ali and Mr. Vikas Dubey, learned Counsel for the respective appellants. Also heard Mr. Ranbir Singh Marhas, learned Additional Advocate General, appearing for the respondent-State and Mr. Pankaj Agrawal, learned Counsel appearing for respondent No.2 &3 /SUDA. Learned Counsel appearing for respondent No.2&3/SUDA submits that the period of mission is likely to be ended by 30th September, 2024. Hence, he states that so far as whether the petitioners/appellants would be absorbed by SUDA or not, he is not in a position to give any statement. Considering the above facts, if the persons who are working through placement shall continue to work till the pendency of the present appeals. 21 List the matters in the first week of October, 2024. ” 12. After passing of the said interim order has continued from time to time till date. 13. A query was put to the learned counsel for the appellant/writ petitioners as to what would be the position of the appellants/writ petitioners when the Scheme has not been extended by the Union of India and the placement agency remains no more in operation, Mr. Dubey submits that as the writ petitioners were earlier working directly under the SUDA, when the extension has not been granted to the placement agency, then the appellants would again continue under the SUDA. Mr. Dubey further submits that as most of the appellants/writ petitioners have been working since 1999-2000 i.e. more than 25 years, and now all of a sudden, they cannot be thrown out of their employment. 14. It has been submitted by Mr. Agrawal that if the Scheme in question is extended by the Central Government, the same would be continued through the placement agencies but the SUDA cannot direct those placement agencies with which agreements would be entered into between them, that they should appoint the appellants/writ petitioners. 15. Annexure R-2&3/5 is a communication dated 14.03.2017 by the Under Secretary to the Government of India to the CEO, SUDA, which is a clarification regarding the contractual engagement of Cos through Man Power Consultancy Agency. The said letter states that (i) Technical Experts required for the SMMU and CMMU may be recruited through open advertisement. State may appoint a Selection Committee headed by the State Mission Director for the screening and selection of Technical Experts for the SMMU and CMMUs, and (ii) the State may use the option of appointing an external agency to provide services of 22 Technical Experts in SMMU and CMMU, if it is felt to be the best option given the conditions specific to the State/city. The said letter further clarifies that either of the above options may be considered for recruitment of experts and Cos at SMMU and CMMUs, meaning thereby that the State was not bound to directly take the services of the writ petitioners/appellants but the same could be done by the placement agencies, which has been continued for a very long time. 16. It is undisputed fact that the appellants/writ petitioners were employed under the private respondents-placement agencies and not under the SUDA and now the Scheme in question itself has come to an end, as reported by the counsel for the respondent-SUDA. The fact of the matter remains that most of the appellants/writ petitioners have been working for a very long period, partly under the SUDA and partly under the placement agencies, and as such, we deem it appropriate to direct the respondent-SUDA that in case, the Scheme is question is continued/ extended by the Central Government and the SUDA choses to implement the Scheme through placement agencies, some preference may be granted to the appellants/writ petitioners for appointment and in case the SUDA choses to continue the Scheme on its own, then in that case also, the petitioners may be granted preference for appointment. 17. With the aforesaid observation and direction, these appeals stand disposed of. Interim order granted earlier stands vacated.
