By way of instant second appeal, the appellant has challenged the judgment and decree dated 06.12.2016 passed by Additional District Judge, Dhamtari in Civil Appeal No.37-A/2014. By the said judgment the first appellate Court had dismissed the first appeal and affirmed the judgment and decree dated 23.09.2014 passed by the trial Court i.e. First Civil Judge, Class- I, Dhamtari, in Civil Suit No.121-A/2013. The instant second appeal was admitted for hearing by order dated 21.06.2019 on the following substantial question of law:- “Whether finding of the Court below refusing to take the additional documentary evidence like two registered deeds of sales, both dated 28.01.1980, executed in favour of Hema Bai by rejecting the application filed under Order 41 Rule 27 of the Code of Civil Procedure, 1908 and thereby granting the decree for partition in respect of the property in question bearing Khasra Nos.770/1 & 770/2 described in plaint Schedule (c), is perverse?” 3. However, during the pendency of the second appeal, as per the special mediation drive initiated by the Hon’ble Supreme Court for settling the dispute through mediation the matter was placed before the mediation centre of this Court. In view of the compromise entered into between the parties, the judgment and decree dated 23.09.2014 passed by the trial Court i.e. First Civil Judge, Class-I, Dhamtari, in Civil Suit No.121-A/2013 and affirmed by the Additional District Judge, Dhamtari, in Civil Appeal No.37-A/2014 by the judgment and decree dated 06.12.2016 is modified to the terms agreed between the parties. 5. Accordingly, the second appeal is disposed of in the light of compromise entered into between the parties. 6. A decree be drawn up in accordance with the compromise dated 23.07.2025 in Mediation R.M/822/2025 as has been entered into between the parties. The terms of the compromise be made part of the decree.
