The second appeal has been filed by the appellants/plaintiffs under Section 100 of the C.P.C. against judgment and decree dated 04.08.2017 passed by the learned Fourth Additional District Judge Raigarh, District- Raigarh (C.G.) in Civil Appeal No. 102/2015 by which the appeal preferred by the appellants/plaintiffs has been dismissed affirming the judgment and decree dated 28.11.2015 passed by the learned First Civil Judge Class-II, Raigarh, District- Raigarh (C.G.) in Civil Suit No. 191-A/2013 wherein the suit preferred by the appellants/plaintiffs for declaration of title and permanent injunction has been dismissed. 2. In pursuance of direction issued by this Court on 18.08.2025, the parties have appeared before Additional Registrar (Judicial) of this Court and statement of the respondents namely Prabhat Chandra Panda, Tarini Prasad Panda, Praveen @ Praveer Chanddra Panda, Amrendra Panda, Devendra Panda, Subodh Kumar Panda, Durgeshwari Panda, have been recorded wherein they have stated in unequivocal terms that they are agreed upon the terms of the agreement. 4. Since the parties have already settled their dispute, therefore, the judgment and decree passed by the trial Court is modified as per the compromise arrived at between the parties. 5. Consequently, the instant second appeal is disposed of in terms of compromise arrived at between the parties. 6.
