The question of law involved m this batch of petitions is asto whether the appointments of the petitioners, who have been appointed after due selection on the posts of Shiksha Karmi Grade- II and Grade-III, can be cancelled on the ground of submission of alleged false and forged documents by some of the candidates, without affording an opportunity of hearing ? Hence, these cases are decided by this common order.

The indisputable facts, in all these matters, are that the petitioners were selected for appointment on the posts of Shiksha Kamii Grade-II and Grade-III through proper selection process and they were accordingly appointed. The petitioners joined their respective posts at respective places. 4. Feeling aggrieved, the petitioners have filed the instant petitions seeking a direction to quash the impugned orders and to grant relief of continuation of their services on the respective posts and places.

Leamed counsel appearing for the petitioners would submit that once the petitioners have been appointed after following proper selection process and after verification of the documents, their appointments cannot be cancelled without affording an opportunity of hearing. Per conta-a, leamed counsel appearing for the State as well as leamed counsel appearing for the respective Janpad Panchayats would submit that admittedly the petitioners were not granted an opportunity to put forward their cases before their appointments on the posts of Shiksha Karmi Grade-II and Grade-III were cancelled. However, since the entire appointments have been cancelled, it was not necessary to issue individual notice and to provide an opportunity of hearing to the individual Shiksha Karmis, separately.

Leamed counsel appearing for the respondents would further contend that after cancellation ofthe appointment ofthe petitioners -^ 58 the entire select lists have been scrutinized and all the cases, where documents were foimd genuine, the second select lists have been prepared and their appointments are continuing. It further contended that most of the petitioners herein are placed in the second select lists and fheir appointments are continuing as per their earlier appointment orders.

8. I have heard rival contentions of leamed counsel appearing for the parties, pemsed the pleadings and documents appended thereto. It is admitted that the petitioners were appointed pursuant to the proper selection process and after verification of their documents. Subsequently, it was found that some of the documents filed by some of the candidates/petitioners were not genuine, therefore, the entire appointment orders, which were made pursuant to the proper selection process, were cancelled.

9. The decision of the Supreme Coiut in the matter of P. Radhakrishna Naidu & Others V. Government of Andhra Pradesh , relied on by the counsel for the petitioners is not applicable to the facts of the present cases, as the said case deals with reappointment of compulsorily retired persons. Further the case ofA. N. Pathak & Others v. Secretary to the Government, Ministry of Defence and another is also not applicable to the facts of the present cases. Similarly, the decision in the matter of Krishan Yadav & another Vs. State of Haryana and others also ofno help to the facts ofthe present cases.
