Respondent(s) (Cause Title is taken from Case Information System) For Petitioners : For State : Mr. Shubham Bajpai, Panel Lawyer Mr. Manharanlal Sahu, Advocate Hon'ble Shri Justice Rakesh Mohan Pandey Order on Board 11.09. 2025 1) The present petition is directed against the order dated 01.09.2014 passed by the respondent No.2–Collector, Mahasamund in Revenue Case No. 06/B- 121/2013-14 (State of Chhattisgarh v. Dulari & Others), whereby the lease granted to the petitioners in respect of forest land has been cancelled. -4- 2) Brief facts of the present case are that the petitioners are permanent residents of village Malidih, Tehsil & District Mahasamund. Their ancestors have been residing in the said village for about 300 years. The petitioners belong to agriculturist families and their livelihood is dependent upon forest produce. Considering their long possession, the State of Chhattisgarh granted them lease by order dated 14.02.2014. However, by the impugned order dated 01.09.2014, the Collector cancelled the lease without following the due procedure provided in the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (for short the Act, 2006) and the Rules framed thereunder. 3) Learned counsel for the petitioner would submit that the impugned order is arbitrary and unsustainable, as the procedure prescribed under Rules 6, 7 and 12 of the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Rules, 2007 (for short the Rules, 2007) has not been followed. It is argued that the Collector has no authority to withdraw forest rights once granted. He has placed reliance on the judgment passed by the Bombay High Court in the matter of Lalba Nana Bethekar v. Sub-Divisional Officer & Others, 2017 (4) Mh.L.J. 433. 4) on the other hand, learned State counsel submits that the petition is not

maintainable, as the impugned order is appealable. It is further submitted that upon enquiry, it was found that the petitioners did not satisfy the eligibility criteria for grant of forest land lease. 5) Heard learned counsel for the parties and perusal documents placed on file. 6) From perusal of the documents, it is evident that the petitioners had been issued documents of title under Annexure-II in terms of Rule 8H of the Rules, 2007. Once such recognition of forest rights is granted, the grievance, if any, can only be addressed before the Sub-Divisional Level Committee under Rule 14, and thereafter before the District Level Committee under Rule 15. Neither the Act, 2006 nor the Rules, 2007 confer power upon the Collector, acting individually, to -5- cancel or withdraw forest rights already granted. 7) In the present case, the Collector, Mahasamund has passed the impugned order in his official capacity without exercising the jurisdiction of the District Level Committee, and without following the procedure prescribed under the Act, 2006 and the Rules, 2007. The procedure adopted is not sustainable. Accordingly, the writ petition is allowed. The impugned order dated 01.09.2014 passed by respondent No.2 is quashed insofar as it relates to the petitioners.
